사행성 게임물과 과잉규제의 역설 (The Gambling Game and the Paradox of Overregulation)

초록

본 연구는 게임 산업을 양성하기 위해서 사행성을 부가한 정책이 역설적으로 사행성을 음성화시키면서 게임 산업까지 위축시킨 과정을 정책집행이론과 규제정치이론에 근거하여 풀이해본 것이다. 2006년 7월 경품제공유기기구인 ‘바다이야기’ 사태는 게임 산업을 육성하기 위해 게임에 사행성을 결합하여 대한민국을 도박광풍에 빠뜨리는 정책결과를 초래했다. 결국 노무현 정부는 성인게임장에서 사행성을 몰아내기 위해서 경품허용 금지 등 과잉규제를 통하여 게임 산업을 함께 몰아낼 수밖에 없는 정책선택을 하였다. 이렇게 형성된 과잉규제에 대해 정책집행주체와 규제대상 집단이 선택적으로 불응하면서 정책효과가 왜곡될 수밖에 없었던 것이다. 따라서 현실적으로 고려할 수 있는 두 가지 정책대안을 제시해보았다. 첫째, 정책목표를 적절한 수준에서 조율하여 영업시간과 베팅액수를 제한하면서 건전한 성인게임장 업주들이 영업이익을 확보할 수 있도록 하는 제도설계를 제안했다. 둘째, 게임은 순수성을 유지하면서 흥미를 유발할 수 있는 산업으로 육성하고, 도박을 의미하는 사행행위는 사행행위특별법이라는 별도의 허가 장치를 통해 예외적으로 양성화시켜 관리하는 것이 합리적인 대안임을 제안했다. 사행성은 인간의 본성에 가깝기 때문에 현실을 무시하고 일방적으로 억제하려는 정책선택은 음성적인 불법행위를 만연케 하고 풍선효과를 극대화시키기 때문이다.

영어초록

Why does the wholesome adult game culture and industry promotion program fail to achieve the policy’s goals? The purpose of this study is to answer this question and to find the causes of the ineffectiveness in the adult game improvement program implementation. The Adult Game Stimulating Program is composed of rooting out illegal adult gambling games, and promoting the sound development of the adult game industry. For this purpose a framework is built, which includes five factors affecting policy results. The main findings are as follows.
First, the paradox of overregulation was embedded in the adult game policy program, and it was not designed causally in terms of the causality of the policy means. Second, the Ministry of Culture and Tourism produced overregulation of eradicating adult gambling games rapidly in the policy-making process in January, 2007 because political actors could not help having a regard for President Roh's pressure and public opinion after the so-called sea-story gate in June, 2006. Third, policy responses of the intermediary local-governments were selectively implemented between the dilemmas of eradicating illegal adult games and local game industry promotion. Fourth, the policy target groups showed much discontent and a high degree of noncompliance due to financial deficit and poor management through overregulation after January, 2007. Fifth, the press and magazines featured sensational reports and articles after the so-called sea-story scandal in June, 2006. These external factors affected overregulation after January, 2007 and influenced eradicating the adult game industry as well as illegal games.
The result of this study confirms the hypothesis that the above factors influenced the policy goals of healthy game culture and industry promotion without satisfying the expectations. So, we suggest that decision makers should consider concerned policy actors carefully to overcome these obstacles including the balloon effect. We also suggest that adult game programs based on the agreements among all stakeholders should be implemented equitably and openly.
