수사상 압수물의 위탁보관에 관한 연구 - 한국환경공단의 압수물 위탁보관과 자원화 사업을 중심으로 - (Research on Consignment Custody of Confiscated Articles under Investigation -Focused on Consignment Custody of Confiscated Article at Korea Environment Corporation and Resource Recovery Business-)

초록

2006년도부터 경찰 등 수사기관에서 사행성 게임기 등 수사과정에서 대규모로 압수되는 압수물에 대하여 한국환경공단과 협약을 통해 보관과 폐기․자원화 하고 있는 위탁보관 사례를 집중적으로 고찰해 보았다.
한국환경공단은 압수물 자원화로 인해 2011년까지 약 831억원의 자원화 실적과 445억원의 순수익을 거두었고, 경찰에서도 1,268억원의 예산절감 등 매우 긍정적인 성과가 있는 것으로 분석되었다.
운영과정에서 드러난 문제점으로는 압수물량 감소로 인해 금년 들어 공단의 대규모 적자가 예상되고, 압수물을 1년 이상 장기보관함에 따른 관리비용 증가, 미확인 압수물 증가, 경찰의 압수물 관리 체계 부실 등을 지적할 수 있다.
이를 개선하기 위하여 경찰에서는 사건 담당과 별도로 압수물 관리 담당과 보관담당을 지정하여 3원화된 관리 체계를 마련하여 그간 사건담당이 압수물 관리를 하였던 관행을 개선토록 하고, 압수물 관리 전산시스템을 개발 시범운영을 거쳐 본격 도입할 예정이며, 검찰 의존적인 압수물 등 증거물 관리 행정을 탈피하여 경찰 자체적인 증거물 관리 규칙의 제정을 추진하는 등 압수물 위탁보관의 시행에 따라 발전적인 경찰 수사행정의 전기가 마련되고 있다고 평가할 수 있다.
압수물 위탁보관이 지속되기 위해서는 자원화 사업의 수익성이 개선되어야 하며, 이를 위하여 공단 자체적인 투입비용의 절감노력과 게임산업진흥에 관한 법률에 의하여 지방자치단체의 지원을 받는 방안, 장기보관 압수물에 대한 경찰의 비용징수 방안, 정부 출연금을 보전 받는 방안을 제시할 수 있으며, 경찰에서도 압수물 위탁보관에 대한 일정 비율의 비용부담과 장기위탁 압수물에 대한 통제가 필요하다.

영어초록

The consignment custody cases of storaging, discarding, or recycling of large scale confiscated articles that were under investigations of gambling games at investigation organizations such as police offices has been studied under agreement with Korea Environment Corporation (KEC) from 2006. Recycling confiscated articles had brought KEC of approximately 83.1 billion won of recycling performance by 2011 and 44.5 billion won of net revenue. It is analyzed that police offices also achieved very positive effect of budget reduction of 126.8 billion won.
The problems on the operation process were reduction of confiscated articles is estimated to bring a loss of 5 or 6 billion won this year, increase of managing cost to storage the articles over a year, increase of unidentified articles, poor managing system of confiscated articles at police offices, and so on.
Due to improve these issues, police offices will improve the original custom that officers in charge of the cases manage confiscated articles and establish a management system with three separated officers in charge of cases, managing confiscated articles, and storaging confiscated articles. Additionally, it is planned to adopt the digital confiscated article management system through development and trial operation. It is evaluated that the former period of police investigation administration is being established by forwarding evidence management rules and conducting consignment custody of confiscated articles autonomously instead of dependant management.
To continue the consignment custody of confiscated articles, profitability of recycling business has to be improved. Therefore, reducing the start-up cost, methods to be supported by local government through Game Industry Promotion Act, collecting charge on long-term storage of articles, and being supported by the Government has to be reviewed. Police also has to review the grounds for the certain expenses on consignment custody of confiscated articles and the control on long-term storage of articles.
