우즈베키스탄의 물적 담보법제에 관한 연구 (A Study on the Real Security Law System of Uzbekistan)

초록

우즈베키스탄은 우리나라와는 정치적․경제적인 측면에서는 긴밀한 관계에 있는 국가이다. 이러한 우즈베키스탄은 완전하지는 않지만 어느 정도의 법체계는 가지고 있다.
우즈베키스탄의 법률체계는 CIS(Commonwealth of Independent States)로 부터 독립 후 자본주의 법체계가 도입되었으나, 구소련의 영향을 받아 우즈베키스탄의 법률체계는 성문법주의 및 대륙법계를 취하고 있으며, 민법과 상법의 합일주의를 취하고 있다.
우즈베키스탄의 법률체계 중 채무이행보장수단으로서 역할을 수행하고 있는 담보의 형태는 양도담보, 부동산담보 및 권리의 담보로 나눌 수 있는데, 이러한 형태의 담보는 민법, 담보법 및 저당법 등에서 규율하고 있다.
우즈베키스탄 민법상 담보는 계약이나 법률을 근거로 하여 발생하는데, 우즈베키스탄에서 담보계약은 서면작성을 요구하고 있으며, 이는 담보의 형태에 관계없이 일반적으로 요구되는 조건이다. 또한 경우에 따라서는 공증 및 등기가 요구된다.
담보는 피담보채권의 소멸, 담보물의 멸실 또는 손상의 가능성이 있는 경우, 담보권설정자의 청구, 담보권자가 담보물에 대해 선관의무를 위반한 경우에 담보권설정자의 소멸청구, 담보물의 멸실 또는 담보권의 종료, 담보물의 경매를 통한 매각(민법 제281조) 등을 충족한 경우에 종료된다. 또한 계약에 특별한 규정이 없으면 담보목적물의 매각은 법원의 경매를 통해 진행된다. 다만, 재산권에 대한 담보의 경우에는 법률이 정한 절차에 의해서 담보권설정자가 담보권자에게 권리를 양도할 수도 있다.

영어초록

Uzbekistan has a close relationship with Korea in the political and economic dimensions. Although Uzbekistan is not complete, the country has a somewhat law system. However, even though the country is equipped with a somewhat law system, it could not be said yet that Uzbekistan is completely a country ruled by a law in applying and executing the law system.
Uzbekistan has introduced the capitalistic law system after liberation from CIS(Commonwealth of Independent States) but under the influence of the old Soviet Union, its law system has taken a form of Written Constitution or Civil Law system, seeking a consolidation of civil law and commercial law.
In the Uzbekistan law system, security or collateral which plays a role as a means for guaranteeing the delivery of debts can be divided into transfer security, real estate security and security of rights and the securities are governed by civil law, security law and real estate security law.
Securities in civil law in Uzbekistan arise of and are based on contracts or laws. Uzbekistan law requires all security contracts to be made in writing, which is a general requirement irrespective of the type of securities. And the law sometimes requires a security contract to be tested by public notice and to register with the authorities, depending on the case.
Securities are extinguished by the following way: extinction of secured debts, a possibility of security loss or damage, request of security pledger, request of extinction by security pledger at a time when a mortgagee violates his/her fiduciary duty, loss of security or termination of security right and selling of security at auction(Article 281, Civil Law).
Unless otherwise provided in the contract, selling of the secured property is conducted at auction by a court. Provided, in the event of security for property right, the security pledger may transfer its right to the mortgagee in accordance with the procedure defined in law.
