물 갈등에 관한 물관리위원회, 지역주민, 시민단체의 활성화 방안 (A Study on the Revitalize Water Management Committee, Local Residents, and Civic Organizations on Water Conflicts)

초록

물 관리 체계의 비효율적 운영을 해결하고 국민의 물 기본권을 보장하기 위하여 「물관리기본법」이 2018년 제정된 이후 3년이 지났다. 물관리위원회와 주민, 시민단체가 향후 물 갈등의 문제점을 극복하고 활성화 위해서는 첫째, 물관리위원회 인적 구성에 물 관련 전문 민간인을 물관리위원회 위원으로 위촉하여야 하고 분야별로 물관리위원회를 구성하여 분과별 위원회에서 물 관리 체계의 전문성을 극대화 하여야 한다. 둘째, 물관리위원회는 의결･심의 한다고 물관리기본법에 규정하고 있어 자문위원회로서 심의기관 또는 행정위원회로서 의결기관인지 모호한 법적규정으로 법리해석에 어려움이 따른다. 물관리위원회의 기본계획 수립과 변경 사항은 물 관리 기능에서 자문위원회의 기능으로 하고 물 관리의 수계 범위 지정, 물 공급량의 적정배분, 수자원 평가 기능은 물 관리 체계에서 상당히 중요한 기능이므로 행정위원회로서 의결기관으로 하여야 물 관리 운영체계에서 효율적이고 합리적이다. 따라서 물 분쟁 사항이 의결사항인지 심의사항인지로 물관리위원회가 개회되기도 전에 논쟁이 된다면 옳지 않으므로 물 관리 기능 사항을 개별적으로 규정함이 바람직하다고 본다. 셋째, 물관리위원회의 조정이 ‘민법상 화해’로 간주되면 조정이 되더라도 강제집행을 할 수 있는 효력이 없으므로 반드시 조정의 효력이 ‘재판상 화해’의 효력을 부여하여야 한다. 넷째, 물관리위원회는 현지 조사 시 참고인의 위원회 출석과 관계기관 협조 및 관련 자료, 의견 제출, 기술적 지식 제공만을 요청할 수 있다고 규정(물관리기본법 제34조)하고 있어 물 분쟁을 효율적이고 능률적으로 해결하기 위해서는 물관리위원회에 직접조사권을 부여하여야 한다. 다섯째, 이해관계 당사자인 주민들이 무엇보다 자기 지역을 잘 알기 때문에 물 관리 정책 계획 단계부터 지역주민을 사전적으로 참여시키고 물 관련 전문가의 의견을 수렴하면 물 관리 정책 추진이 능률적이고 효율적이라고 본다. 여섯째, 시민단체가 공공기관과 국가에 쓴 소리를 하는 견제기능도 있지만 정부나 집권 정당에 붙으면 편향적 방향으로 전환되어 제대로 된 정책 결정에 방해가 되는 결과를 초래 하므로 시민단체들의 의지대로 투명하고 중립적이며 독립적으로 운영되도록 하여야 한다. 일곱째, 지역주민의 알권리인 정보접근권, 정보열람권, 정보공개권이 최대한 보장되어야 하고 올바른 시민단체로 지속되기 위해서는 대중매체와 적당한 거리를 두고 물 관련 이해당사자에게 방향을 정확히 알려주는 나침반이 되어야 한다. 지역주민이 공정하게 물 관련 정책을 추진하여야 하고 시민단체는 우리 사회의 소수자와 다수자를 대변하는 중재자로서 최선의 노력을 다하여야 한다.

Three years have passed since the Framework Act on Water Management was enacted in 2018 to resolve the inefficient operation of the water management system and ensure the basic rights of the people. In order for the Water Management Committee, residents, and civic groups to overcome and revitalize the water conflict in the future, first, water-related civilians should be appointed as members of the Water Management Committee and water management committee should be formed to maximize the expertise of the water management system. Second, the Water Management Committee stipulates in the Framework Act on Water Management that resolutions and deliberations are made, so it is difficult to interpret the law due to ambiguous legal regulations whether it is a deliberation agency or an administrative committee. The basic plan and changes of the Water Management Committee are the functions of the Advisory Committee in the water management function, and the water supply range designation, appropriate allocation, and water resource evaluation function are very important functions in the water management system. Therefore, if the water dispute is disputed even before the water management committee is opened, it is not correct, so it is desirable to separately define the water management function. Third, if the mediation of the Water Management Committee is regarded as "civil law reconciliation", there is no effect of compulsory execution even if mediation is made, so the effect of mediation must give the effect of "judicial reconciliation". Fourth, the Water Management Committee stipulates that only witnesses can attend the committee, cooperate with related agencies, submit related data, opinions, and provide technical knowledge (Article 34 of the Framework Act on Water Management), so in order to efficiently and efficiently resolve water disputes, the water management Fifth, since residents who are interested parties know their regions better than anything else, it is considered efficient and efficient to implement water management policies by participating local residents in advance and collecting opinions from water-related experts from the water management policy planning stage. Seventh, the right to information access, information access, and information disclosure, which are the right to know of local residents, should be guaranteed as much as possible, and in order to continue as a proper civic group, it should be a compass that informs water-related stakeholders accurately. Local residents should fairly promote water-related policies, and civic groups should make their best efforts as mediators representing minorities and the majority in our society.
