민법상 공작물책임과 국가배상법상 영조물책임의 관계 (The Relationship between Civil Code's Responsibility for Structures and State Compensation Act's Official Act Responsibility)

초록

국가배상법 제5조에 대한 정확한 이해는 국가배상법 제2조와 민법 제758조와의 올바른 관계설정에서 가능한 것이다. 먼저 국가배상법 제2조에 따른 공무원의 직무상 불법행위로 인한 손해배상책임이 헌법 제29조에 근거한 기본권인 국가배상청구권을 구체화하는 것으로 보아야 하는 것과 달리, 국가배상법 제5조에 따른 영조물책임은 공물관리권의 관점에서 접근하는 것이 타당하다. 이러한 공물관리권에는 공물의 유지, 수선, 보존이 당연히 포함되므로 공물의 유지, 수선, 보전이 제대로 이루어지지 않아서 국민에게 손해가 발생한다면 당연히 공물주체가 그에 대한 손해배상책임도 져야 할 것이다.
다음으로 민법 제758조의 공작물책임은 사법상 권리인 점유권 또는 소유권 행사에 대한 법적 한계를 지우기 위하여 민법이 특별히 인정한 손해배상책임이므로 공작물을 설치 또는 보존하는 자가 국가나 지방자치단체와 같은 행정주체이어야 할 필요는 없고, 혹시 국가나 지방자치단체가 설치 또는 보존을 하는 경우에도 공물이 아닌 경우에는 민법 제758조의 공작물책임이 적용될 수 있다.
이와 같이 민법 제758조의 공작물책임과 국가배상법 제5조의 영조물책임은 책임의 성격도 다르고 적용대상 및 책임의 주체로 서로 다르지만, 하자의 개념이 동일하기 때문에 물적 하자의 판단기준 뿐만 아니라 기능적 하자의 판단기준도 동일하게 적용될 수 있다. 다만 입법론적으로는 국가배상법 제5조의 배상주체를 국가 또는 공공단체로 바꾸어 지방자치단체가 아닌 공공단체도 국가배상법 제5조에 따른 영조물책임을 지도록 할 필요가 있다.

영어초록

The accurate understanding of Article 5 of the State Compensation Act is possible only by properly establishing its relationship with Article 2 of the same Act and Article 758 of the Civil Act. First, while the liability for damages arising from an unlawful act committed by a public official in the course of duty under Article 2 of the National Compensation Act should be regarded as concretizing the fundamental right to claim state compensation based on Article 29 of the Constitution, the liability for structures under Article 5 of the State Compensation Act should be approached from the perspective of public property management.
The management rights of public property naturally include maintenance, repair, and preservation. Therefore, if public property is not properly maintained, repaired, or preserved, resulting in damage to citizens, the entity responsible for the public property must also bear liability for such damages.
Next, the liability for structures under Article 758 of the Civil Act is a special type of liability recognized by the Civil Act to impose legal limitations on the exercise of private rights such as possession or ownership. Therefore, the entity responsible for installing or maintaining a structure does not necessarily have to be an administrative body such as the state or a local government. Even if the state or a local government installs or maintains a structure, if it is not public property, the liability for structures under Article 758 of the Civil Act may apply.
As such, while the liability for structures under Article 758 of the Civil Act and the liability for structures under Article 5 of the State Compensation Act differ in nature, applicable subjects, and liable entities, the concept of defects is the same in both cases. Thus, not only the criteria for determining physical defects but also the criteria for determining functional defects can be applied equally. However, from a legislative perspective, it would be necessary to amend Article 5 of the State Compensation Act to specify that the liable entity includes not only local governments but also public organizations, thereby extending the liability for structures under Article 5 to public organizations as well.
