한·미 쇠고기협상 합의문에 대한 국제법적 평가와 대책방향 (Legal Analysis of Agreed Documents in Korea-U.S. Beef Negotiations and Policy Directions for Korea)

초록

한미 쇠고기합의서는 국제법상의 약식조약으로 유효하게 성립되었으므로, 미측에 대해 조약무효를 이유로 재협상을 주장할 수 있는 국제법상의 근거가 없다. 쇠고기합의서의 문제점인 검역주권 문제를 보완하기 위해 체결된 제1차 교환서한은 쇠고기합의서에 우선하는 특별법적 성격의 조약으로 성립되었고, 미국에서 광우병 재발시 우리측이 즉시 수입중단을 주장할 수 있는 문안상의 근거를 마련하긴 하였으나, 송신문과 답신문간의 정합성의 부족으로 해석을 둘러싼 분쟁의 여지가 내재해 있다.
제2차 추가협상시 타결된 장관서한을 비롯한 합의문들은 신사협정의 성격을 지니어 국제법상의 구속력은 없으나, 그 내용이 국내 고시를 통해 국내법적 구속력을 획득하였으며, 쇠고기합의서 해석의 고려요소로 작용하게 된다. 다만, 수출자율규제 체제에 대한 정부의 지원 합의가 국내소송 및 WTO협정 위반을 불러일으킬 가능성이 있는 한계가 있다. 그럼에도 불구하고, 재협상이 현실적으로 불가능한 상황에서 선택한 불가피한 과도체제이므로, 그 실효성을 담보하고 문제점을 보완할 수 있는 국내 보완입법이 필요하다. 궁극적으로는 미국과 일본간의 쇠고기협상 결과를 반영하여 현재의 한미합의서 내용을 개정함으로서 보다 합법적이고 안정적인 조약체제로 전환해야 한다. 아울러 미국산 쇠고기의 수입재개에 따른 국내 축산업의 장기 발전 정책을 수립할 필요가 있는바, 국제통상규범에 합치하고 국제경쟁력을 함양하는데 초점을 맞추어 선택과 집중 원칙에 기초한 발전정책이 일관성 있게 추진되어야 할 것이다.

영어초록

The Protocol of Import Health Requirements for U.S. Beef and Beef Products between Korea and the United States is a valid treaty according to international treaty law, and the Korean Government does not have a right to request renegotiation to the U.S. Government based on the ground of invalidity of the treaty. The exchanged letters between trade ministers of the two countries, agreed to as a result of the first additional negotiation, constitute a treaty prevailing over the protocol. In these letters, Korea successfully introduced a line of textual ground by which Korea can claim its priority right to take an immediate import prohibition measure against U.S beef upon reoccurrence of BSE in the United States. However, given the lack of textual correspondence between the sent and respondent letters, possibilities of disputes over the interpretation of the priority right are latent.
On the other hand, the legal nature of agreed documents adopted as a result of the second additional negotiation is not one of treaties but of gentlemen's agreements. Although these documents are not legally binding upon the parties, their contents were copied into the notice of the MIFAFF of Korea to become integral parts of domestic law of Korea. A problem arises that a variety of governmental supports for the voluntary export/import restraint (VER) programs agreed to in these documents may violate the VER provision under the WTO agreements.
Despite this potential violation, Korea should take effective monitoring measures over the VER programs for there is no alternative. Enactment of complementary regulations for the effective implementation of the programs is also recommended. As a long-term solution, Korea should make efforts to amend the current protocol with the U.S. in reference to the outcomes of the on-going U.S.-Japan beef negotiations. Also, a long-term policy regarding the development of the Korean beef industry must be implemented consistently with the international norm of subsidies and in order to promote international competitiveness of the domestic industry of Korea.
