초록

대상판결의 판시 이전에도 대법원과 헌법재판소의 판결을 통하여 한의사의 무면허 의료행위에 대한 판단이 이루어져 왔다. 이번 대상판결은 종전 판단기준과 다른 ‘새로운 판단기준’이라고 명명하면서 기존 판례를 변경하였다. 대상판결의 다수의견이 밝히고 있는 ‘새로운 판단기준’은 크게 세 가지 측면에서 종전 판단기준과 차이가 있다고 한다. 과연 대상판결의 다수의견처럼 ‘새로운 판단기준’인지에 대하여 의문이 든다. 왜냐하면 종전 판단기준이라 불리우는 대법원 판결과 이와 비슷한 시기에 판결한 대법원의 판결 그리고 헌법재판소의 결정례를 살펴보면 ‘새로운 판단기준’이라기 보다는 서로 모순된 견해를 ‘정리’하는 차원으로 보인다.
그러나 대상판결의 다수의견은 긍정적 측면에서 바라볼 판시사항도 있다. 즉 과학과 의료공학의 발달에 따라 의료영역은 직역 간 중첩 영역이 발생할 수 있다. 대상판결의 다수의견은 이러한 중첩 영역을 인정하였다는 점은 긍정적 평가로 볼 수 있다. 이러함에도 불구하고 여전히 남은 숙제가 있다. 어느 정도의 범위까지 중첩 영역을 허용할 것인지이다. 이것은 의사와 한의사의 직역 간 갈등의 문제로 보아서는 안 된다. 또한 대상판결을 통하여 한의사에게 모든 서양의학에 기반을 둔 의료기기 사용을 허용한 것으로 보아서도 안 된다. 이에 더 나아가 우리나라에 존재하는 특수한 상황인 이원화된 의료체계를 일원화로 전환하는 것도 바람직한 방향은 아니다. 따라서 의사와 한의사가 중첩적으로 사용할 수 있는 의료기기가 무엇인지를 제도적･입법적으로 해결할 필요가 있다.

영어초록

Even before the judgment of the target judgment, judgment on the unlicensed medical practice of oriental doctors has been made through the judgments of the Supreme Court and the Constitutional Court. This target judgment changed the existing precedent, naming it a 'new judgment criterion' that is different from the previous judgment criteria. It is said that the 'new judgment criteria' disclosed by the majority opinion of the target judgment are largely different from the previous judgment criteria in three aspects. Indeed, like the majority opinion of the target judgment, a question arises as to whether it is a 'new judgment criterion'. When looking at the Supreme Court ruling, which is called the previous judgment criterion, the Supreme Court ruling at a similar time, and the decision of the Constitutional Court, it seems to be a 'resolution' of contradictory views rather than a 'new judgment criterion'.
However, there are also judgments that the majority opinion of the target judgment should look at from a positive perspective. In other words, with the development of science and medical engineering, overlapping areas may occur in the medical field. It can be seen as a positive evaluation that the majority opinion of the target judgment recognized these overlapping areas. Despite this, there is still homework to be done. To what extent the overlapping area will be allowed. This should not be viewed as a matter of conflict between the directives of doctors and oriental doctors. Also, it should not be considered that oriental doctors were allowed to use medical devices based on all Western medicine through the target judgment. Furthermore, it is not a desirable direction to convert the dualized medical system, a special situation existing in Korea, to unification. Therefore, it is necessary to systematically and legislatively solve what medical devices doctors and oriental doctors can use overlappingly.
