초록

본 연구에서는 자격기본법상 벌칙 규정과 관련된 사이버대학교 상담관련학과의 민간자격 표시의무 준수실태를 분석하고 개선방안을 제시하고자 하였다.
민간자격의 신설 및 등록은 원칙적으로 자유로우나, 자격기본법은 특정 분야를 금지분야로 설정하여 규제하고 있다. 이러한 민간자격을 광고할 때에는 관련 법령에 따른 표시의무를 준수해야 하며, 이를 위반할 경우 법적 제재를 받을 수 있다. 본 연구에서 19개 사이버대학교의 29개 상담관련학과 홈페이지에 광고된 민간자격 206건을 분석한 결과, 자격명을 제외한 제반 표시의무 준수 수준이 낮은 것으로 나타났다.
본 연구대상의 표시의무 준수실태를 살펴보면, 자격기본법령상 민간자격 표시의무를 제대로 준수하지 않아 형사처벌의 대상이 될 수 있고, 일부 민간자격에서 금지분야인 ‘치료사’ 자격을 사칭하고 있으며, 부실하게 민간자격 표시의무 사항을 광고하는 문제점을 확인하였다. 이에 대한 발전방향으로 첫째, 공식적인 민간자격 표시의무 모니터링 전담기구를 도입하고, 주무부장관의 시정명령에 따른 공표제도 마련과 시정명령 불이행에 따른 고발권의 필요성을 제언하였다.

영어초록

This study aims to analyze how well counseling-related departments at cyber universities comply with the private qualification labeling requirements stipulated by the Framework Act on Qualifications, specifically focusing on the provisions related to penalties. Based on this analysis, the study proposes measures for improvement.
Although the establishment and registration of private qualifications are generally permitted, the Framework Act on Qualifications and its subordinate legislation establish certain prohibited fields. When advertising such private qualifications, the relevant parties must comply with the Obligations to Make Indications; failure to do so is subject to sanctions. Analysis of the subjects in this study revealed that, with the exception of the qualification name, the level of compliance with the Obligations to Make Indications in private qualification advertisements is low.
An examination of the labeling compliance practices of the subjects in this study revealed several issues. Non-compliance with the private qualification labeling requirements of the Framework Act on Qualifications and its subordinate legislation could lead to criminal prosecution. Furthermore, some private qualifications were found to be fraudulently using the title "therapist," a designation prohibited in certain fields. Finally, there were instances of inadequate advertising that failed to properly include the required labeling information. To address these issues, this study proposes the following: First, a dedicated official body should be established to monitor compliance with private qualification labeling requirements. Second, a system should be implemented to publicly announce corrective orders issued by the relevant minister. Finally, the relevant authority should have the right to file criminal charges for non-compliance with such corrective orders.
