군복무 학점인정제도 도입에 대한 헌법적 검토- 군복무자 지원제도의 요건에 대하여 - (A Constitutional Review on the Introduction of theCredits Recognition System of Military Service - Regarding the requirements of the military service support system -)

초록

최근 국방부가 일부 대학들과 군복무 기간을 학점으로 인정하기 위한 협약을 체결하였다는 언론보도가 있었다. 군복무 학점인정제는 많은 군인들이 대학을 휴학하고 입대하는 현실에서 그들의 학업단절에 대한 보상 취지에서 필요성이 제기된 것이다. 그러나 1999년 헌법재판소의 위헌결정으로 폐지된 군가산점제와 제도의 성격, 갈등 양상 등이 유사하다는 점에서 논란이 되어 왔다. 본 논문에서는 군복무 학점인정제가 군가산점제와 어떤 점에서 같고 어떤 점에서 다른지, 군복무 학점인정제가 군복무자 지원제도로서 적합한지를 판단하였다.
군복무 학점인정제는 대학의 자율적인 참여로 이루어지기 때문에 대학에 대한 직접적인 강제가 아니고, 군가산점제의 경우처럼 군복무자에 대한 혜택이 여성 및 장애인의 기회를 박탈하는 것은 아니기 때문에 위헌의 소지는 없다고 할 수 있다. 그러나 국방 의무의 형평성 확보를 위해 제도를 마련해야 할 국가의 책임을 간접적으로 대학에 떠넘기고 있다는 점에서 다소 문제가 될 수 있고, 군복무자 지원제도라고 하기에는 혜택을 받을 수 있는 군복무자의 범위가 너무 적고, 혜택의 정도도 미미하다는 점에서 실효성은 없는 제도라고 판단된다.
군복무자들이 겪는 학업단절의 문제를 해결하기 위해서는 군복무 자체를 학점으로 인정하는 것보다 군복무 중 학업을 계속할 수 있도록 여건을 마련하는 것이 본질적인 해결책이라고 생각한다. 이미 군복무에 따른 학업단절문제를 해소하고 군대에서 학업을 계속할 수 있도록 e-러닝 시스템(대학원격강좌)이라는 제도가 마련되어 있다. 따라서 e-러닝 시스템이 활성화될 수 있도록 대학과 정부, 그리고 군대가 함께 노력을 기울여야 할 것이다.

영어초록

Recently, there was a media report that the Ministry of National Defense signed an agreement with some universities to recognize the military service period as credits. The credits recognition of military service comes from the necessity of rewarding many soldiers for their disruption in school, as they take a break from university and are conscripted into the military. However, it has been controversies because the additional points system of the military service, which was abolished by the Constitutional Court’s decision in 1999, has similar characteristics and conflicts. In this paper, it was judged on how the additional points system of military service is the same and different from the credits recognition system of military service and whether the credits recognition of military service is appropriate as a support system for military service.
The credits recognition of military service is not unconstitutional. Because it is not a direct enforcement to universities because it is carried out by the voluntary participation of the universities and it does not deprive women and disabled people of opportunity as in the case of the additional points system for the military service. However, it may be a bit problematic in that the government’s responsibility to prepare the system to ensure fairness of its military duty is indirectly handing over into universities. And It is considered to be ineffective because the number of soldiers who can benefit from the system is too small and the level of benefits is small.
In order to solve the problem of their disruption in school, I think it is essential to provide conditions for continuing to study during the military service rather than recognizing the military service itself as credits. There is already a system called e-learning system (the Cyber lecture of university) that can continue studying in the military. Therefore, universities, governments and the military should work together to enable the e-learning system.
