작은사업장에서 모·부성보호제도 시행을 위한 시론 : 비판적 문화기술지방법 (Communication Analysis On the Maternal & Paternal Protection System in Small Sized Enterprise : Critical ethnography Research Method)

초록

한국 여성노동자 고용률은 결혼·임신·출산·육아로 인해 여전히 M자곡선이고 이를 변화시키기 위해서는 모·부성보호제도 시행을 확산하는 것이 시급하다. 여성노동자의 60.5%가 종사하고 있는 30인 미만의 사업장에서는 육아휴직 등 모·부성보호제도의 사용이 쉽지 않은 경우가 여전히 흔하다. 모·부성보호제도는 강제조항이고 처벌조항이 있음에도 그러하다.
왜 작은사업장에서는 모·부성보호제도가 제대로 지켜지지 않을까 하는 것이 본 논문의 문제의식이다. 이에 작은사업장의 대표들을 대상으로 한 토론식 인터뷰 결과를 하버마스 방식(Habermas Way)의 비판적 문화기술지 연구방법으로 분석하였으며, 분석결과는 첫째, 제도실행 여부에 대한 판단 근거에 대한 것이다. 회사가 어렵다는 공통된 배경지식(문화), 어려움을 같이 극복해야 한다는 연대감(사회), 이를 책임지고 해결해 나가야 한다는 리더십이라는 정체성(인성)은 생활세계의 일상적인 의사소통 행위를 이어나가게 하고 이를 통해 육아휴직을 포기하게 만들었다. 둘째, 정당성에 대한 실질적인 주장이다. 회사의 생존과 노동자의 권리를 양자택일로 보며 육아휴직 신청을 ‘이기적 행위’라고 몰아붙이는 것이다. 셋째, 사회적·정치적 관계의 재생산이다. 사업주와 육아휴직 신청노동자, 그리고 나머지 노동자는 ‘사업주의 육아휴직 포기를 설득시킨 지위, 신청자의 권리 포기당함’으로 그들의 권력관계가 재생산되었다.

영어초록

The employment rate of Korean female workers is still an M-shaped curve due to marriage, pregnancy, childbirth, and childcare, and in order to change this, it is urgent to expand the implementation of the maternal and paternal protection system. The apply for maternal and paternal protection systems, such as childcare leave, is still often difficult in workplaces with fewer than 30 employees, where 60.5% of female workers are employed. This is true even though the maternal and paternal protection system is compulsory and has punitive provisions.
The focus of this paper is why the maternal and paternal protection system is not properly observed in small businesses. Accordingly, the results of discussion-style interviews with representatives of small businesses were analyzed using the critical ethnography research method of the Habermasian Way. First, the analysis results are about the basis for judgment on whether or not to implement the system. The common background knowledge that the company is facing financial difficulties(culture), the sense of solidarity that we must overcome these difficulties together(society), and the identity of leadership that requires us to take responsibility and solve them(character) enable us to continue our daily communication activities in the life-world, and through this, it made him give up parental leave. Second, it is a substantive claim to legitimacy. They view the survival of the company and the rights of workers as an either-or choice, and call the demand for parental leave a ‘selfish act.’ Third, it is the reproduction of social and political relationships. The power relationship between the employer, the worker applying for childcare leave, and the remaining workers was reproduced as ‘the employer remains in the position of persuading the worker to give up childcare leave, and the worker is given up his right to childcare leave.’
