미국의 낙태죄 관련 주요판결의 모자보건법에 대한 시사점 (The Mother-Child Health Act and the Implication of the U.S. Supreme Court’s Decisions.)

초록

1973년의 Roe v. Wade 판결은 여성의 낙태권을 본질적 권리로 인정하면서이른바 3개월 기간구분법을 통하여 낙태시술의 가능여부를 판단하였다. 하지만1992년의 Planned Parenthood v. Casey 판결은 비록 Roe v. Wade 판결의 핵심적 판시사항을 다시 한 번 인정한 것으로 평가받으면서도 그 세부적 판시사항 중 일부를 파기한 것으로 평가된다. 구체적으로 3개월 기간구분법을 파기하고 엄격심사기준을 통한 주정부의 낙태규제의 합헌성 심사를 대신하기 위하여이른바 부당한 부담 심사기준이라는 새로운 기준을 창출하였다.
우리나라의 경우 낙태는 형법을 통하여 원칙적으로 금지되는 행위이고 모자보건법상의 사유가 예외적으로 허용된다. 또한 낙태권은 미국과 달리 기본적으로 인정되지 않는다. 이 때 허용을 위한 예외의 적용에 있어서 주요 전제조건은 태아의 독립적 생존이 가능하지 아니한 임신 초기 24주 이내의 낙태시술이어여 함은 물론이고 법률혼 혹은 사실혼 배우자의 동의이다.
낙태에 대한 우리나라 고유의 법체계가 갖는 특성을 고려할 때 예외적으로허용되는 낙태시술의 전제조건으로서 배우자의 동의는 재검토가 필요하다. 이는 배우자에게의 고지 수준으로 그 요건이 경감되는 것이 적절하다.

영어초록

Asked to address the issue of abortion again, the Supreme Court by a vote of 5-4 affirmed its 1973 decision of Roe v. Wade, which established a constitutional right to abortion under the Due Process Clause of the Fourteenth Amendment.
However, in Planned Parenthood v. Casey, the court made it more difficult for women to succeed in challenging laws that were less than absolute prohibitions on abortion. The court ruled that in order to succeed in a constitutional challenge, a law must be shown to have the purpose or effect of placing a substantial obstacle in the path of a woman seeking an abortion. Under this test many abortion restrictions have been upheld,including requirements that require women to make multiple trips to an abortion provider and to suffer an enforced delay prior to obtaining an abortion. The Court rejected Roe’s trimester framework and adopted an “undue burden” standard to determine whether a law violates a woman’s right to abortion. The Court used this standard to strike down the spousal notification requirement of the Pennsylvania statute being addressed.
Basically, Korean Criminal Law criminalizes any abortion while the Mother-Child Health Act legalizes abortion only under few circumstances.
Moreover, the law requires women to be in pregnancy within the period of week 24 because week 24 means the starting point of fetal viability. Also,the law requires women to get spousal consent before abortion. Because of the dual system of abortion law in Korea, it is uncertain for the Mother-Child Health Act to require such spousal consent.
Just as some states in the United States attempted to enact laws requiring spousal consent for abortion, the Korean abortion law, the Mother-Child Health Act, requires that abortion should be permitted only if there is spousal consent for abortion. All of these laws in the U.S. with spousal consent in the 1976 decision of Planned Parenthood v. Danforth and spousal awareness in the 1992 decision Planned Parenthood v. Casey have been ruled unconstitutional.
It is needed for Korea to have spousal notification rather than spousal consent to regulate illegal abortions within the Mother-Child Health Act because spousal notification would be enough to apply the Act in order to legalize illegal abortions.
