국민권익위원회의 법적 지위와 조직법적 과제- 국가청렴위원회로의 전환에 따른 몇가지 쟁점 - (A Study on the Legal status and organizational legislative challege of the Anti-Corruption and Civil Rights Commission- A Critical Review under the Transition to the Korean Independent Commission Agai)

초록

2008년도에 국민권익위원회가 출범할 때, 국민고충처리위워회, 국민청렴위원회 그리고 국무총리행정심판위원회가 하나로 통합되어, 조직적으로는 하나가 된 것 같았다. 그러나 실질적으로는 국민권익위원회와 행정심판위원회의 두 개로 구성된 것과 마찬가지였다. 그리고 업무에 따라 정책기구적 행정위원회와 준사법적 행정위원회의 두 위원회가 존재하였으며, 정책기구적 행정위원회도 부패방지업무는 보조적 기능에 그쳤으며, 고충민원업무에 있어서는 결정적 기능을 가지고 있었다. 대국민서비스를 하나로 통합하여 효율성을 추구하고자 통합하였지만, 원래의 의도와 달리, 위원회는 어정쩡한 법적 지위를 가지게 되었다.
그러한 현상적이고 본질적인 문제점을 해결하고자, 2018년 1월 국민권익위원회로부터 행정심판위원회가 분리되고, 국민권익위원회는 고충처리위원회의 기능보다 부패방지의 기능을 중심으로 한 국가청렴위원회로 재생되는 ‘부패방지 및 국민권익위원회의 설치와 운영에 관한 법률 일부개정법률안’이 제안되었다.
중앙행정심판위원회가 분리되고 국민권익위원회가 국가청렴위원회로 재생되었을 때, 정치적 중립성, 전문성 및 독립성을 강화하기 위한 방안으로써 국무총리 산하에 있는 국민권익위원회를 제4의 국가기관 즉 제4의 권력을 가진 헌법기관으로 격상하거나, 대통령소속으로 전환하고, 그에 따른 조사권･수사권･기소권 등을 어느 정도 부여할 것인가에 대하여 고찰하였다. 또한 국가청렴위원회에 고위공직자부패범죄수사권을 부여할 수 있는 방안을 검토하였으며, 이 경우에 대물적 관할과 대인적 관할을 어떻게 변경하는 것이 바람직한가에 대한 저자의 견해를 기술하였다.

영어초록

When the Anti-Corruption and Civil Rights Commission was launched in 2008, the Ombudsman of Korea, the Korean Independent Commission Against Corruption and the Administrative Appeals Commission seemed to be united and organized together. But in reality, it was like the Anti-Corruption and Civil Rights Commission and the Administrative Appeals Commission. There are two committees: the policy instrumental administrative commission and the quasi-judicial administrative commission. The policy instrumental administrative commission also has a secondary function in the anti-corruption task and a decisive function in handling civil grievances. It integrated the services of the people into one to pursue efficiency, but unlike the original intention, the committee had an unfair legal status.




In January 2018, ‘the partially revised legislative Bill of Act on the Prevention of Corruption and the Establishementand Management of the Anti-Corruption and Civil Rights Commission’ was proposed to address such phenomenal and essential problems. The Bill separates the Administrative Appeals Commission from the Anti-Corruption and Civil Rights Commission. In addition, the contents of the Bill regenerated the Anti-Corruption and Civil Rights Commission as the Korean Independent Commission Against Corruption and strengthened the function of prevention of corruption rather than the function of Ombudsman.




In order to strengthen political neutrality, professionalism and independence, the Anti-Corruption and Civil Rights Commission (the Korean Independent Commission Against Corruption) under the Prime Minister has been promoted to a constitutional authority with a fourth power or proposed to be a member of the presidency. And I consider the extent to which the right of investigation and prosecution are given.




In addition, we reviewed the ways in which the Korean Independent Commission Against Corruption could grant investigative power against high-ranking public officials' corruption. In this case, I describe my view on how to change in rem jurisdiction and inpersonam jurisdiction Respectively.
