개정된 「검사와 사법경찰관의 상호협력과 일반적 수사준칙에 관한 규정」의 몇 가지 문제점 (Some problems with the amendments to 「the Regulations on Mutual Cooperation of Prosecutors and Law Enforcement Officers and General Standards of Investigation」)

초록

2020년 형사소송법 개정은 우리 형사사법체계에 큰 변화를 가져왔다. 법률 개정의 취지를 반영하여 수사준칙이 제정되었지만, 경찰·검찰의 협력관계, 구체적 수사절차 등에 대한 규율이 충분하지 못했던 것으로 보인다. 이에 윤석열 정부는 지난 1년여간 수사준칙 개정을 위해 협의를 진행해왔다. 특히 신속하고 내실있는 민생사건 수사, 경찰과 검찰의 책임 수사, 경찰과 검찰의 협력 강화 등을 염두에 두고 개정 수사준칙을 마련한 것을 보인다. 수사기관의 고소·고발 접수 의무 강화, 수사기한 명시 등 의의를 찾을 수 있는 조문들이 확인된다.
그러나 개정취지에 공감하기 어려운 조문들도 있고, 복잡한 조문들을 분석하면 개정의 취지에 역행하는 조문들도 있는 것으로 보인다. 특히 경찰·검찰의 책임수사를 고려한 보완수사의 주체 문제, 재수사요청의 범위를 확대하였으나 인권보장절차는 미흡한 문제, 경찰·검찰의 협력 의무화에 다소 우려되는 문제, 피의자의 방어권 보장 미흡 문제 등이 확인된다. 아울러 수사권 조정의 취지에 대한 재인식과 함께 인력조정의 문제 등도 함께 병행하여 논의될 필요가 있다.
개정 수사준칙에 대한 보다 활발한 논의가 이어지기를 희망한다.

The 2020 amendments to the Criminal Procedure Code brought about significant changes to our criminal justice system. Although the Investigation Guidelines were enacted to reflect the intent of the amendment, it seems that there were insufficient regulations on police-prosecutor cooperation and specific investigation procedures. The Yoon administration has been consulting on the revision of the Investigation Guidelines for over a year, and it seems that the revisions have been prepared with the following objectives in mind: prompt and thorough investigation of civil cases, accountability of police and prosecutors, and enhanced cooperation between police and prosecutors. There are some provisions that can be found meaningful, such as strengthening the obligation of investigative organisations to receive complaints and accusations and specifying the time limit for investigations.
However, there are some provisions that are difficult to agree with the purpose of the amendment, and there are some provisions that seem to go against the purpose of the amendment when analysing the complex provisions. In particular, there is a problem with the subject matter of the supplementary investigation considering the responsibility of the police and prosecutors, a problem with the expansion of the scope of the request for reinvestigation but the lack of a human rights guarantee procedure, a problem with the obligation of police and prosecutors to cooperate, and a problem with the lack of guarantee of the suspect's right to defence. In addition, the issue of staffing coordination needs to be discussed in parallel with a reconsideration of the purpose of coordination of investigative powers.
