國會規則의 性格에 관한 몇 가지 문제 (Several Issues on the National Assembly Regulation)

초록

헌법 제64조 제1항에서는 『국회는 법률에 저촉하지 아니하는 범위 내에서 의사와 내부규율에 관하여 규칙을 제정할 수 있다』고 규정하고 있다. 필자는 이 규정과 관련하여 이 글에서 다음과 같은 결론을 도출하고 있다.
첫째는, 헌법에서 국회가 제정하는 의사와 내부규율에 관한 법규범에 대해 『규칙』이라는 용어를 사용하고 있다고 하여 국회규칙의 지위에 대해 法段階說에서 말하는 법률보다 하위개념으로서의 지위만 인정하여서는 아니 된다. 그리고 국회와 함께 독립된 헌법기관인 대법원, 헌법재판소, 중앙선거관리위원회가 제정하는 법규범에 대해 국회규칙에서 사용하는 『규칙』과 동일한 용어를 사용하고 있다고 하여 모두 동등한 효력을 인정할 것도 아니다. 국회규칙을 제정하는 국회는 입법권을 가지고 있기 때문에 국회규칙에 대해서는 법률로서의 지위가 인정되어야 한다.
둘째는, 국회규칙에 대해 법률로서의 효력을 인정하는 경우에 법률규정과 충돌하는 국회규칙의 효력이 문제되는데, 필자는 헌법 제64조 제1항 규정에도 불구하고 국회규칙은 저촉되는 법률을 묵시적으로 폐지하거나 개정할 수 있는 가능성을 인정하고 있다.
셋째는, 국회법 제166조 제1항에서는 『국회는 헌법 및 법률에 저촉되지 아니하는 범위 안에서 의사와 내부규율에 관한 규칙을 제정할 수 있다』고 규정하지만 동 국회법 규정은 헌법 제64조 제1항과 실질적으로 同語反覆(tautology)의 규정일 뿐 국회규칙의 제정에 대한 위임근거가 되는 것은 아니라는 점이다.

영어초록

Article 64 (1) of the Constitution provides “The National Assembly may establish the regulations of its proceedings and internal disciplines: Provided, That they are not in conflict with Act.” The writer draws several conclusions in relation of that Article in this essay.
First, we should not treat the National Assembly Regulation as a mere regulatory norm the status of which is lower than legal norm, as Article 64 (1) of the Constitution uses the notion of ‘regulation’. And we should bear in mind that, though National Assembly Regulation uses the same notion of ‘regulation’ like regulations of other independent constitutional organizations such as Supreme Court, Constitutional Court, and National Election Commission, the normative status of the National Assembly Regulation is not same with those of other independent constitutional organizations. The normative status of National Assembly Regulation is law while those of the other independent organization are under-stage than law. This difference stems from the lawmaking power of the National Assembly. The National Assembly can take the legal norm instead of regulatory norm when they think fit.
Secondly, if provisions of the National Assembly Regulation collide with those of a previous law, the possibility of indirect abolishment or repeal of the provisions of the law by those of the inconsistent Regulation should not be denied irrespective of Article 64 (1) of Constitution.
Thirdly, Article 166 of the National Assembly Act can not be the ground of delegation to National Assembly for establishing the regulations concerning proceedings and internal disciplines, as Article 166 of the National Assembly Act provides “The National Assembly may establish the regulations concerning proceedings and internal disciplines within the scope of not contrary to the Constitution and Acts,” that Article is only a tautology of Article 64 (1) of the Constitution.
