성립면에서 본 근대 입헌주의적 헌법과 현대 사회국가적 헌법의 비교 (A comparative of the contemporary constitutionalist constitution and modern socialist constitution from the perspective of their establishing)

초록

본 연구는 시간상으로 근대와 현대에 만들어진 헌법을 근대헌법 또는 현대헌법이라 부르지 않고 근대 입헌주의적 헌법 또는 현대 사회국가적 헌법이라고 통칭하는 것에 착안하여 그 의미와 내용을 찾고자 하는 데에 있다. 헌법의 경우에는 그 성립에 있어서 시대에 방점이 있는 것이 아니라 그 내용에 방점이 있기 때문에 시대개념에 의미개념을 더하여 근대 입헌주의적 헌법과 현대 사회국가적 헌법으로 표현하고 있다. 본 연구는 헌법의 역사적 전개의 과정에 대한 연구에 중점을 두는 것이 아니라 근대 입헌주의적 헌법과 현대 사회국가적 헌법이 담고 있는 헌법의 가치와 핵심내용에 대한 정리에 그 중점을 두고자 한다. 방법상으로 헌법의 전체에 대하여 다루는 것이 아니라 헌법이 성립하기 위하여 가장 필수적인 요소가 되는 사상적 토대, 권력의 담당자 및 헌법이데올로기의 규범화라는 세 가지의 요소에 따라 정리를 하였다. 근대 입헌주의적 헌법의 사상적 토대가 개인주의 및 자유주의였다면 현대 사회국가적 헌법의 사상적 토대는 복지주의이며, 근대 입헌주의적 헌법에서의 권력의 담당자는 군주와 국민의 이원적 체제였다면 현대 사회국가적 헌법에서의 권력의 담당자는 국민이다. 헌법이데올로기의 규범화의 측면에서 살펴보면 근대 입헌주의적 헌법에서는 국민주권주의, 권력분립주의, 기본권 보장(자유권 중심), 성문헌법주의 및 법치주의를 그 내용으로 하고 있지만 현대 사회국가적 헌법에서는 이러한 내용이 시대의 정신에 맞게 발전적으로 변모하게 된다. 즉 현대 사회국가적 헌법에서는 국민주권주의의 실질화, 적극국가에 따른 권력분립주의의 변용, 기본권 보장(사회권 보장의 강화), 법치주의의 실질화, 정당국가화 경향, 헌법재판제도의 도입 및 국제 평화주의를 그 내용으로 포함하고 있다. 본 연구는 근대 입헌주의 헌법과 현대 사회국가적 헌법에서의 이와 같은 내용의 의미가 무엇인지와 어떠한 기능을 가지고 있는지에 대하여 고찰한다. 이를 통하여 헌법의 원리와 규범내용을 보다 명확하게 하고자 한다.

영어초록

This study, having got its idea from the fact that constitutions made in the modern and contemporary time are not called ‘the modern constitution,’ or ‘the contemporary constitution,’ but ‘the modern constitutionalist constitution or the modern socialist constitution,’ tried to find their meaning and contents. In the case of constitutions, their focus is not found in the time they are made but in their contents, in which sense they are called ‘the modern constitutionist constitution and the modern socialist constitution,’ to whose time concept the concept of their meaning is added. This study tried to put stress not on studying the historical unfolding of constitutions but on arranging the values and core contents contained in the modern constitutionalist constitution and the modern socialist constitution. Technically, it does not deal with the whole constitution but arranges it by categorizing ideological bases, ones in charge of power and constitution ideologies. Liberalism and individualism can be said to have been the ideological base of the modern constitutionist constitution and ones in power in the modern constitutionist constitution were a binary system of kings and people. But ones on power in the modern socialist constitution are people. Seen from the categorizing aspect of the constitutional ideologies, the modern constitutionist constitution states people sovereignty, power balance, guaranteeing basic rights(civil liberties focused), written constitution and legalism but these contents in the modern socialist constitution gets changed to meet the spirit of the time. That is, the modern socialist constitution contains substantiation of popular sovereignty, major alteration to power balance pursuant to positive state, guarantee of the basic rights(security of social rights strengthened), substantiation of legalism, tendency toward a state led by political parties, introduction of the constitutional court system and global pacifism. This study considered what meaning and what functions these contents have in the modern constitutionalist constitution and the modern socialist constitution, through which it tried to clarify constitutional principles and contents of its norms.
