초록

COVID-19 팬데믹 이후 정보통신기술(ICT) 교육 시대에 대응하기 위해 학교 교육에서 저작물의 이용 및 저작권법 개선이 중요한 이슈로 부각되고 있다. 교육기관에서 비대면 교육의 질적 향상을 도모하기 위해, 콘텐츠의 공정이용 및 효율적인 권리처리 방안 모색이 필수적이다. 본 연구는 언택트 사회에서 비대면 교육 수요의 증가에 따른 저작물 이용 환경 변화와 기술 발전을 반영하여, 저작권법 제도의 개선 방향을 도출하고자 한다. 특히 본 연구에서는 현재의 저작권 제도가 새로운 교육 환경에 부합하지 않는 한계와 문제점을 면밀히 분석하고, 이러한 문제를 해결하기 위한 다양한 대안을 제시할 것이다.
학교 교육 목적으로 저작권에 대한 우려 없이 교육 저작물에 접근하고, 이용하며, 공유 및 유통할 수 있는 비자발적 이용 허락 체계의 마련이 필요하다. 이를 통해 기존 보상금 제도를 보완하고, 교육목적을 위한 법정 허락 제도의 도입 가능성을 탐구해야 한다. 또한 저작권법 내에서 학교 교육 목적의 이용, 인용 및 공정이용 조항의 조화로운 해석을 통해 저작권자와의 상생 방안을 마련해야 한다.
본 연구는 학교 교육 목적의 저작물 이용을 안전하게 할 수 있는 비자발적 이용 허락 체계를 마련하고, 저작권자와의 협력적 관계를 구축하는 데 기여할 것으로 기대한다. 이러한 노력은 비대면 교육환경에서 저작물 이용의 원활한 확산과 교육의 질 향상이 촉진될 것이다.

영어초록

In response to the exigencies arising from the COVID-19 pandemic, the intersection of copyright law and educational practice has become an area of paramount importance. The utilization of copyrighted works for educational purposes necessitates a critical examination of existing legal frameworks to facilitate the advancement of non-face-to-face education within educational institutions. Therefore, it is of utmost importance to investigate the doctrine of fair use and to develop robust mechanisms for the effective management of rights therein. This study endeavors to delineate a coherent pathway for the enhancement of the copyright law system, taking into account the transformative changes occurring in the usage of copyrighted works alongside substantial technological advancements. These developments are integral to addressing the surging demand for educational modalities characterized by non-personal engagement in a contactless society.
To this end, a comprehensive analysis must be undertaken to identify the inherent limitations and challenges embedded within the current copyright framework. Such a framework, as it stands, remains largely misaligned with the evolving educational landscape. Accordingly, this study will propose a series of viable alternatives aimed at rectifying these deficiencies. Central to this discussion is the establishment of an involuntary use permission system that would facilitate seamless access to, utilization, sharing, and dissemination of educational works specifically for scholastic purposes, devoid of copyright encumbrances. Such a system should enhance the existing compensation dynamics for copyright holders while assessing the practicality of a statutory permission model tailored for educational contexts. Furthermore, it is imperative to architect a framework conducive to coexistence with copyright holders, predicated upon a harmonious interpretation of pertinent provisions within the Copyright Act. This includes, but is not limited to, those provisions regarding use, quotation, and the doctrine of fair use as applied within educational settings.
In conclusion, this study aspires to cultivate a collaborative rapport with copyright holders through the introduction of an involuntary use permission system, thereby fostering a secure environment in which copyrighted materials may be engaged for educational objectives. It is anticipated that such initiatives will catalyze the unhindered dissemination of copyrighted works in non-face-to-face educational contexts, thereby significantly enhancing the overall quality of education.
