온라인서비스제공자의 불법정보 삭제･차단의무에 대한 연구 — 전기통신사업법과 정보통신망법의 개정 내용을 중심으로 — (A Study on the Obligations of Online Service Providers to Delete and Block Illegal Information — With a Focus on the Amendments to the Telecommunications Business Act and the Information and Communica)

지난 2020년 6월 9일 일부 개정되어 12월 10일 시행을 앞두고 있는 전기통신사업법에서는 법 소정의 부가통신사업자 등에게 자신이 운영･관리하는 정보통신망을 통하여 일반에게 공개되어 유통되는 정보 중 성폭력범죄의 처벌 등에 관한 특례법과 아동･청소년의 성보호에 관한 법률에서 규정하는 불법촬영물 등이 유통되는 사정을 신고, 삭제요청 또는 대통령령으로 정하는 기관･단체의 요청 등을 통하여 인식한 경우에는 지체 없이 해당 정보의 삭제･접속차단 등 유통방지에 필요한 조치를 취하여야 하고(제22조의5 제1항), 이들 중 일정한 범위의 사업자들에게는 불법촬영물 등의 유통을 방지하기 위하여 일련의 기술적･관리적 조치를 하여야 한다(제2항)고 규정하고 있다. 이와 같은 일자에 개정되어 시행을 앞두고 있는 정보통신망 이용촉진 및 정보보호 등에 관한 법률에서는 일정한 정보통신서비스 제공자로 하여금 자신이 운영･관리하는 정보통신망을 통하여 일반에게 공개되어 유통되는 정보 중 불법촬영물 등의 유통을 방지하기 위한 책임자를 지정하도록 하고(제44조의9 제1항), 이 책임자는 전기통신사업법 제22조의5 제1항에 따른 불법촬영물 등의 삭제･접속차단 등 유통방지에 필요한 조치 업무를 수행한다고 규정하고 있다. 이는 소셜 미디어의 사용이 대중화됨에 따라 발생하는 불법적 행위에 대처하기 위해 시급한 조치가 필요하다는 사회적 관심이 크게 높아진 시기에 이러한 목적을 위해 불법정보의 유통을 가능하게 하는 온라인서비스제공자로 하여금 문제가 되는 정보를 모니터링하거나 삭제할 의무를 부담하게 하는 일련의 법안들이 발의되었고 최종적으로 위와 같은 관련 법 개정에 이르게 되었다. 사회적으로 큰 관심을 모으는 사건의 발생은 자연스럽게 불안감을 가라앉히고 동종 및 유사 범죄의 예방을 확실하게 하기 위해 강력한 대응 조치를 불러오게 되겠지만 이러한 법적 조치가 헌법적으로 정당성을 인정받기 위해서는 관련된 헌법상 기본권의 보장, 사이버 공간의 특성 및 헌법적 의의, 나아가 정책의 실제적 효과에 이르는 폭넓은 분석과 검토가 필요하다. 그렇지 않으면 근시안적인 법 개정이나 과격한 정책의 도입, 부실한 제도의 변경이 인터넷상에서의 국민의 표현의 자유를 위축시키거나 침해하는 한편 관련 사업에 부당한 부담을 가중하는 결과를 야기하게 될 가능성이 높다. 이 글에서는 위의 관련 법 개정 사항에 대해 입법 경과와 그 내용을 중심으로 헌법적으로 문제가 될 수 있는 논점들에 대해 분석･검토함으로써 해당 분야에서의 법 개정이나 제도 개선을 위해 착안하고 주의해야 할 점들에 대해 인식을 깊게 하고 지침을 확인하는 계기로 삼고자 한다.

영어초록

The Telecommunications Business Act, which was partially amended on June 9, 2020 and is due to be implemented on December 10, 2020, directs that, where a value-added telecommunications business operator pursuant to law recognizes, by reporting, requesting deletion, or requests from organizations or groups specified by Presidential Decree, the circumstances where any illegal photographs, etc. specified in the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes or the Act on the Protection of Children and Youth Against Sex Offenses are circulated among information made available to the public and circulated through the telecommunications networks he or she operates and manages, the person shall promptly take necessary measures to prevent the circulation of the relevant information, such as deleting the information and blocking access thereto (Article 22-5 (1)). In addition, a set of technical and administrative measures shall be taken to prevent the distribution of illegal photographs, etc. by some operators (Article 22-5 (2)). The Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. amended on the same date, requires information and communications services providers to designate a responsible person for preventing the distribution of illegal photographs, etc. among information that is made available to the public and circulated through the information and communications network he or she operates and manages (Article 44-9 (1)). It is stipulated that this responsible person shall take necessary measures to prevent the circulation of the such illegal media, such as deleting the information and blocking access thereto, pursuant to Article 22-5 (1) of the Telecommunications Business Act. There have been social demands for urgent measures coping with illegal activities arising from the popularization of the use of social media. A series of bills were proposed to obligate online service providers, who enable the circulation of illegal information serving criminal purposes, to monitor and delete problematic information. Ultimately, the proposals have led to the legal amendments above. Events which draw intense social interest will naturally beget strong countermeasures to pacify anxiety and ensure the prevention of similar crimes. However, in order for such legal measures to be constitutionally justified, they require extensive analysis and review on issues such as the guarantee of constitutional fundamental rights, the characteristics and constitutional significance of cyberspace, and the practical effects of policies. Otherwise, they risk a diminution or infringement of online freedom of expression on one hand, and undue burden on relevant businesses on the other, due to near-sighted legal amendments, introduction of radical policies, and faulty policy changes. This study analyzes and reviews concerns which may pose constitutional issues, with a focus on the amendments discussed above and their legislation process. In doing so, this study aims to deepen awareness of issues which require attention and caution, as well as to review protocols which must be followed, in the process of revising laws or improving policies.
