평생사회안전망과 취약계층의 권리보장 -사회보장기본법 및 사회적 경제 관련법 중심으로- (The Lifetime Social Safety Net and Guarantee of Rights for Vulnerable Class -On the Framework Act on Social Security and Social Economy-)

초록

본 연구는 취약계층의 개념과 권리를 고찰하고 취약계층에 대한 복지권 보장을 위한 사회복지법제적 과제 성찰을 목적으로 수행되었다. 따라서 2012년 1월 26일 전부 개정된 사회보장기본법을 고찰하고, 사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률, 사회적 경제 관련 법령 등을 고찰함으로써 취약계층의 개념과 범위, 국가와 지방자치단체의 책임, 사회보장급여의 제공, 사회보장 전달체계 운용에 관한 기본법제적 과제를 고찰하였다.
사회보장제도의 대상이 되는 수급권자 개념에서 사회복지적 권리의 보장은 국가와 지방자치단체의 책임에 의하며, 사회보장기본법에 나타난 평생사회안전망과 보편주의적 사회보장제도는 취약계층을 포함한 모든 국민을 대상으로 효율성 있는 사회보장 전달체계를 통한 맞춤형 사회보장제도의 실현을 의미한다. 따라서 취약계층에 대한 복지권 보장의 과제에 대하여 첫째, 사회보장제도의 대상이 되는“사회적 취약계층”및“취약계층”에 관한 합목적적 개념 정의의 필요성, 둘째, 사회보장에 관련된 권리의 법제적 개념 정립과 복지권 보장을 위한 입법 활동, 셋째, 취약계층과 모든 국민의 사회복지에 관련된 인권 영역별 사회복지법의 이해와 인식개선 교육, 넷째, 지역 중심의 맞춤형 사회보장제도를 관장할 수 있는 사회보장 전달체계의 전문성과 지원대상자 발굴 역량 확대를 위한 전담기구 설치와 인력 양성 등을 제언하였다.
아울러 지방정부 중심의 맞춤형 사회보장 전달체계 구축과 사회보장 전담기구 설치에 관한 국가와 지방자치단체의 책무 구체화, 평생사회안전망 실현을 위한 전자복지 구현 및 사회보장정보 전달체계 구축을 위한 후속적 논의를 촉구하였다.

영어초록

The purpose of this study is to consider the concept and rights of vulnerable class and examine legislative tasks for social welfare to secure welfare rights for vulnerable class. Here, this author will consider the Framework Act on Social Security revised entirely on January 26th, 2012, examine the Act on the Use and Provision of Social Security Benefits and Search for Eligible Beneficiaries and the laws of social economy, and figure out basic legislative tasks regarding the concept and range of vulnerable class, responsibilities of the government and local autonomous entities, provision of social security benefits, and the operation of the social security delivery system.
Concerning the concept of qualified recipients subject to the social security system, the government and local autonomous entities are responsible for securing social welfare rights. The lifetime social safety net and universal social security system described in the Framework Act on Social Security mean to realize the customized social security system through the efficient social security delivery system targeting all people including vulnerable class. Therefore, about the tasks of securing welfare rights for vulnerable class, first, it is necessary to define the concept of “socially vulnerable class” and “vulnerable class” subject to the social security system according to the purpose. Second, it is needed to establish the legislative concept of rights associated with social security and legislative activities to secure welfare rights. Third, it is essential to understand the Framework Act on Social Security by the areas of human rights related to social welfare targeting vulnerable class and also all people and provide education to better awareness. Fourth, this author suggests it is needed to install organs and cultivate manpower in charge in order to enhance expertise of the social security delivery system that can be in charge of the region-based customized social security system and improve competence to search the subjects to be supported.
Furthermore, this author urges you to conduct follow-up discussion to build up the customized social security delivery system initiatively by the local government, realize responsibilities of the government and local autonomous entities regarding the installation of organs in charge of social security, actualize e-welfare to realize the lifetime social safety net, and establish the social security information delivery system.
