대만 의료사고 안전망 관련 법제의 주요 내용과 함의 (Main Contents and Implications of Taiwan's Medical Accident Safety net Related Legislation)

초록

의료분쟁으로 인한 부작용은 국가 보건의료체계의 건전한 발전을 저해하는 요소가 될 수 있다. 이에 많은 국가에서는 합리적인 의료분쟁 해결을 위한 제도를 마련하고, 지속적으로 개선해 나가고 있다. 본 연구는 최근 의료사고 안전망을 구축한 대만의 관련 법제인 ‘의료사고예방법’과 ‘출산사고 긴급구호법’의 내용을 분석하여, 우리나라 관련 법 개선 및 논의에서 함의를 도출하고자 했다. 대만의 ‘의료사고예방법’은 의무적 조정전치주의를 채택하고 있다. 이를 위해 지방정부 중심의 의료분쟁 조정 절차, 조정위원회, 의료사고 예방 및 조정을 위한 역할을 규정하고 있다. 또한 법명에서 알 수 있듯이 의료사고 예방에 집중하여 의료사고 예방을 위한 의료기관의 내부체계, 의료사고 발생 시 전담팀 구성, 의료사고 예방을 위한 중앙정부의 재정 및 인력 지원을 주요 내용으로 한다. 대만의 ‘출산사고 긴급구호법’은 우리의 불가항력적 의료사고 보상에 대한 국가적 안전망을 구축한 개별법으로 출산사고 발생 시 의료기관의 역할, 사고 처리를 위한 팀 구성, 사고 발생 시 처리 절차 및 예산 편성과 교육 등의 내용을 규정하고, 보상을 위한 기금 확보, 보상의 절차, 범위 등을 규정하였다. 20년간의 논의 끝에 2022년 제정된 대만의 ‘의료사고예방법’은 소통, 분쟁의 조정, 사고 예방을 3대 원칙으로 설정하여 의료사고 예방을 위한 세부 내용을 규정하였다. 향후 의료분쟁의 추이, 분쟁 조정 과정, 의료사고 예방을 위한 다양한 정책들의 실효성에 주목할 필요가 있다.

영어초록

Medical disputes can be a factor that hinders the sound development of a national healthcare system. As a result, many countries have established systems for rational medical dispute resolution and are continuously improving them.
This study analyzed the contents of the Medical Accident Prevention and Dispute Resolution Act and the Childbirth Accident Emergency Relief Act, which are related laws in Taiwan that have recently established a medical accident safety net, and attempted to derive implications for improving related laws in Korea.
Taiwan's Medical Accident Prevention Act adopted the principle of mandatory mediation.
To this end, it stipulates in detail the medical dispute mediation procedures and methods centered on local governments, the mediation committee, and the roles of the central and local governments. In addition, as the name of the law suggests, it focuses on preventing medical accidents, and mainly stipulates the internal system of medical institutions for preventing medical accidents, the formation of a dedicated team in case of a medical accident, and the financial and human resources support of the central government for preventing medical accidents.
Taiwan's Childbirth Accident Emergency Relief Act stipulates the role of medical institutions in the event of a childbirth accident, the composition of a team to handle the accident, the handling procedures in the event of an accident, budget allocation, and education, and stipulates the securing of funds for compensation, compensation procedures, scope, etc. After 20 years of discussion, Taiwan's Medical Accident Prevention and Dispute Resolution Act, enacted in 2022, sets communication, dispute mediation, and accident prevention as the three major principles and stipulates detailed contents for preventing medical accidents. Therefore, it is necessary to pay attention to the trend of medical disputes in the future, the dispute mediation process, and the effectiveness of various policies for preventing medical accidents.
