초록

휘슬블로어(whistleblower)는 공익신고자나 내부고발자 등으로 번역되어 법과 대중 담론에 알려져 있다. 여러 번역어가 존재하는 것은 내부고발에 대한 인식과 내부고발(자)의 속성이 여전히 논쟁적이기 때문일 것이다.
필자는 이 글에서 내부고발의 근본적이고 중요한 특징을 진실을 말하는 행위, 파레시아(parrhesia)로 재규정하고자 한다. 파레시아는 고대 그리스에서 어원을 찾을 수 있으며 1980년대 푸코가 그 문제를 탐구하면서 2010년대 이후 내부고발 연구자들이 이를 적용하면서 활성화되었다. 필자는 25명의 내부고발자와의 인터뷰에 기반한 그들의 서사에서 제보 행위의 가장 큰 전제이자 핵심적 특징이 다름 아닌 그들이 조직이나 조직 구성원의 비리 행위의 ‘사실･진실’을 다른 사람･기관에 ‘발화’하는 행위임을 발견하게 되었다.
푸코에 따르면 고대 그리스의 파레시아의 (긍정적) 특징은 솔직함, 진실, 위험, 비판, 의무인데 현대 내부고발도 위험과 비판의 특징을 갖고 있다. 두 행위는 모두 자신보다 권한이 많은 이에 대한 비판을 함으로써 위험을 감수해야 한다. 그리고 의무는 전자의 경우 국가에 대한 자유인의 공적 의무이고 후자의 경우는 대개 공익으로 표현된다. 솔직함과 진실 부분은 전자의 경우 발화･내용･생활이 합치되면서 그들의 솔직함과 용기가 의심받지 않지만, 현대의 내부고발은 진실 여부를 제도적 수위(법률기관이나 이를 담당하는 공적 기관)에서 검증을 받아야 한다. 이 점이 두 행위의 가장 큰 차이점이라고 할 수 있다.
본 연구는 내부고발을 둘러싼 여러 논의의 시론적 작업으로서 내부고발의 속성을 (정치적 판단과 파장을 낳는) 어떤 사실(비순리적 사안)의 말하기 행위로 보았고, 구체적인 여러 쟁점은 후속연구에서 이어진다.

영어초록

A whistleblower in English is translated into a claimer for public interest or internal discloser in Korean legal system and public discourse. The reason for the multiple translations is that the perception and nature of whistleblowing(whistleblower) are still problematic.
In this article I characterize a fundamental, significant feature of whistleblowing as the act of speaking the truth, parrhesia. The term goes back to the ancient Greek and has been popularized in international academia since 2010s due to the powerful influence of Mitchell Foucault’s studies on the archaeology of the term in 1980s. Based on interviews with 25 whistleblowers I found the main and essential part of whistleblowing is that they ‘speak’ of ‘the truth(wrongdoing of organizational members/organization where they work)’ to others･other institutions.
According to Foucault, the (positive) characteristics of parrhesia in ancient Greek system is frankness, truth, danger, critique and duty and the last two characteristics are visibly presented in whistleblowing too. That is, both two acts have a risk by taking an issue toward those who has more power than the speaker. For duty, the former means free men’s duty to a state and the latter is considered as public interest. For frankness and truth, since the latter means the congruence of speaking act, content and the speaker him/herself, the speaker does not confront any distrust in terms of the speaker’s frankness and courage. But contemporary whistleblowing should be explored to prove speakers’ truthfulness in an institutional･legal level. This is the most distinguishable difference between them.
I consider in this introductory work of whistleblowing, one of main features of whistleblowing the act of speaking the truth (which beget a political judgement and accompanying impacts), critique and several specific issues surrounding whistleblowing will be followed in subsequent studies.
