이른바 ‘막말’에 대한 법적 고찰 (Legal Consideration of So-called ‘Spiteful Speech’)

초록

이른바 ‘막말’은 말의 폭력으로도 표현되지만, 말의 폭력이 계속적으로 상대에게 상처를 입힐 의도로 던져지는 데 반해 폭언으로는 단 한마디라도 다른 사람에게 상처를 주는 실례가 되는 발언이라면 막말이라고 불릴 수 있다. 그러나 이렇게 불리고 패를 때리는 등의 폭언은 모욕죄나 협박죄를 구성할 수도 있다. 이런 말에는 차별과 같은 사회적인 것도 있고, 타인의 신체적 특징이나 개성 중 당사자가 그 특징에 대해 열등감을 갖고 있는 등 부정적인 인상을 갖고 있는 경우도 있지만, 다른 한편에서는 내 뱉어진 말에 당사자가 그 말의 의미에 대해 열등감을 갖고 있지 않은 경우에는 거친 표현이어도 상대방에게 상처를 줄 수 없다. 그러나 말을 하는 측이 상대방을 상처 입히려는 의도로 하는 경우도 ‘막말’의 범주에 해당된다.
막말은 문화적으로 상대성을 갖는다. 막말은 인간 간의 감정적 언쟁 등에서 비롯된 표현이지만 이른바 독설처럼 재주 내지 예능의 영역까지 높인 것도 존재한다. 이는 특정의 대상을 조롱함으로써 웃음을 얻는 것인데, 이 경우는 감정적으로 되어 앞뒤가 맞지 않는 말을 해 버리는 식의 실언이 아니며, 또 직접적으로 다른 사람에게 상처를 주려는 것이 아니기 때문에 주제나 언급하는 장소, 상황도 선택되는 경향이 있다.
본 연구는 이러한 막말의 특수성을 감안하여 우리사회에서 정치권을 비롯하여 최근에는 직장 내 괴롭힘에 이르기까지 비난의 수단으로 사용되는 막말에 대한 사회적 정의와 정당의 후보자 선발권 제한 및 불법행위의 대상이 되는 법률요건으로서 막말에 대한 논의를 진행하였다. 가치관과 막말의 관계는 문화적 배경에 따라 판단이 다를 수 있다. 막말의 종류에 따라서는 받아들이는 측의 가치관에 따라 상대방에게 불쾌감을 주지 못할 수도 있다. 그러므로 막말의 하위개념 내지는 유의어 또는 다른 표현이라 할 수 있는 혐오표현, 정치패러디의 개념정의와 함께 표현의 자유의 한계를 살펴보고, 본고에서 다루게 될 막말에 대한 법규범적인 정의를 내려 보고자 하였다. 인간은 사회를 형성함과 동시에 지극히 뇌가 발달한 감정의 동물이기도 하다. 이 때문에 감정싸움에서 막말이 나오는 것도 사사건건 감정 억제가 잘 안 되는 사람도 흔치 않은 일이 아니다. 방송언어의 심의에서 ‘막말’판단의 고려 사항으로서 상대방의 괴롭힘을 고려할 필요가 있음을 지적하였다.

영어초록

The so-called ‘Spiteful speech’ is also expressed as the violence of a speech, but if the violence of the speech is continuously thrown with the intention of injuring the opponent, even a single word of remark would be called an Spiteful speech if it is an example that hurts another person. However, such words, such as hitting a plaque, may constitute insults or intimidation. Some of these words are social, such as discrimination. Others have negative impressions, such as the inferiority of the other person’s physical characteristics or personality. If one do not have a sense of inferiority to meaning, even a rough expression cannot hurt the other person. However, the case where the speaking party intends to hurt the other person also falls into the category of ‘Spiteful speech.’ The ‘Spiteful speech’ is culturally relativistic. The Spiteful speech is an expression that comes from the emotional struggle between humans, but there are also some that have increased to the realm of talent or entertainment like the so-called spiteful remarks. This is to get a laugh by making fun of a particular object. In this case, it is not an expression of saying that people are emotional and not speaking back and forth, and because people are not trying to hurt others directly, the subject or the place to mention, and the situation also tends to be chosen.
In view of the peculiarities of these Spiteful speech, this study aims at social justice of the Spiteful speech, which are used as a means of criticism, ranging from political society to bullying in the workplace, and restrictions on the right to select candidates for political parties and illegal activities. As a result, the discussion about the Spiteful speech was conducted. Judgment between the values ​​and the Spiteful speech may differ depending on the cultural background. Depending on the type of Spiteful speech, depending on the value of the accepting party, it may not be offensive to the other party. Therefore, the purpose of this study was to look at the limitations of freedom of expression, along with the definition of aversion and political parody, which may be called sub-concepts or synonyms or other expressions of the Spiteful speech, and to try to define the legal normative definitions for the Spiteful speech to be dealt with in this paper. Human beings are also emotional animals that have developed their brains while forming society. For this reason, it is not uncommon for people to have emotional suppression or even the Spiteful speech of emotions. He pointed out that it is necessary to take into consideration the bullying of the other party as a consideration of the ‘Spiteful speech’ judgment in the deliberation of the broadcasting language.
