헌재 2016.4.28.선고2015헌마98결정-성범죄자 취업제한-에 관한 고찰 (A Study on the Constitutional Court 2015 Hun-Ma 98, April 28, 2016-Employment restrictions on sex offenders-)

초록

아동청소년을 대상으로 하든 성인을 대상으로 하든 성범죄자에 대한 엄한처벌은 필요하다. 그러나 성범죄자에 대해서 책임에 상응한 형벌을 부과하는 것은 별론으로 하더라도 현행법은 그에 부가하여 치료감호, 신상정보 등록, 신상정보 공개․고지, 위치추적 전자장치부착, 성충동약물치료, 범죄인의 DNA 시료채취 그리고 취업제한 등 많은 형사제재조치를 담고 있다. 그중에서도 개정 전 아동청소년의성보호에관한법률 제56조 제1항은 아동청소년 대상 성범죄자는 형 집행 종료후 일률적으로 10년동안 아동청소년 관련기관에 취업할 수 없도록 규정하고 있었고 헌법재판소는 청구인의 직업의 자유를 과도하게 제한한다고 보아 위헌결정을 하였다. 이에 대해서는 성범죄 피해자의 특수성을 고려하지 아니한 결정이고 따라서 보다 장기의 취업제한 기간이 필요하다는 비판도 있지만 헌법재판소의 논리는 타당하다고 보인다. 그리고 위 헌법재판소의 위헌결정이후 아청법은 ‘법원이 유죄판결 선고시에 10년의 한도 내에서 재범의 위험성과 기타 특수한 사정을 고려하여 취업제한명령을 부과할 수 있도록’ 개정됨으로써 위헌의 시비를 제거한 바 있다. 그러나 법원이 취업제한 기간을 결정함에 있어서 각급 재판부가 형량을 고려하여 자율적으로 기간설정을 하는 지금의 운영방법보다는 양형위원회의 양형기준과 같은 이른바 ‘취업제한기준’을 마련함으로써 피고인들간의 형평성과 예측가능성을 확보할 필요가 있고 성범죄자에 대한 취업제한 집행중이라도 재범위험성에 대한 심사를 통해 잔여기간의 ‘취업제한 면제․종료’를 내릴 수 있는 절차의 마련도 필요할 것으로 보인다.

The Constitutional court recently has ruled the restriction on employment of the persons convicted or given a medical treatment

A strict punishment is needed for sex offenders targeting children, adolescents and adults. The law contains a number of criminal sanctions including treatment monitoring, personal information registration, disclosure and notification of personal information, location tracking by electronic devices, treatment of sexually transmitted drugs, DNA samples of criminals and employment restrictions, apart from imposing penalties commensurate with responsibility for sex offenders.


Prior to the revision, Article 56 of the Act on the Protection of Sexuality among Children and Adolescents provided that sex offenders for children and adolescents could not be employed by the relevant agencies for 10 years on a uniform basis after their execution of their sentences. But the Constitutional Court ruled against the law because it found excessive restrictions on the rights of claimants to work.


Some critics say that the decision did not take into account the specific nature of victims of sex crimes and therefore requires a longer period of employment restriction, but I think the Constitutional Court's logic seems reasonable.


After the Constitutional Court's ruling on the constitutionality of the law, it removed the dispute over the unconstitutionality by allowing the court to impose a work restriction within a 10-year limit, taking into account the risks of repeat offenses and other special circumstances.


In determining the length of employment restriction, the court needs to ensure fairness and predictability among the defendants by preparing a hypothetical ‘employment restriction standard’ such as the sentencing standard of the penal committee rather than the current operation method in which each level court voluntarily sets the period by considering the sentence. Even during the execution of employment restrictions on sex offenders, it is also likely that the government will need to come up with a procedure to exempt them from and terminate their employment restrictions during the remaining period through a review of their risks of repeat offenses.
