초록

‘대한민국 국민인 남자’(이하 ‘남자’)에 대해서만 병역의무를 부담한다고 정하고 있는 병역법 조항(이하 ‘이 사건 법률조항’)에 대해 헌재가 위헌이 아니라는 결정을 선고하였다.
그런데, 이 사건 법률조항이 남자와 여자를 차별한다는 점에 대해서는 전혀 논증이 없다. 이 사건 법률조항의 문언으로부터 바로 차별이 있다고 판단한 것이다.
그러나, 평등조항이 입법자에게 ‘같은 것은 같게, 다른 것은 다르게’ 처우할 것을 명령하고 있다고 보는 판례에 입장에 의한다면, 병역이라는 부담의 분배원리를 설명하고, 그 원리를 따를 때 각 사람이가진 품성의 비와 병역의무의 비가 일치하는지를 검토하여야 한다.
각자가 가진 품성은 절대적으로 다르므로, 각자가 받는 가치 또는 부담의 양은 절대적으로 달라야 한다.
이에 비하여, 헌법 제11조 제1항 후문은 ‘성별, 종교, 사회적 신분’ 이 분배의 기준으로 작동할 수 없다는 점을 밝히고 있다. 성별이 다르더라도 같게, 종교가 다르더라도 같게, 사회적 신분이 다르더라도같게 처우하여야 한다는 것이 헌법 제11조 제1항 후문의 명령이다.
그러므로, ‘같은 것은 같게, 다른 것은 다르게’로 헌법 제11조 제1 항 후문을 설명할 수 없다. 헌법 제11조 제1항 후문을 설명할 수 없는 이론이라면, 전문을 해석하는 이론으로 받아들일 수 없다.
이 사건에서 헌재가, 이 사건 법률조항이 남자를 차별하고 있다고 단언하는 것은 종래의 이론과 일치하는 것이 아니다. 헌법 제11조 제1항 후문이입법자에 대한 명령으로 받아들여지고, 전문이 입법자에게 주는 명령으로‘같은 것은 같게, 다른 것은 다르게’로 이해하는 판례는 폐기되어야 한다.

영어초록

The Korean Constitutional Court ('the Court') ruled that the Military Service Act provision which declares that only 'men with Korean nationality' (hereinafter 'men') bears the duty of military service ('the Provision') is not in violation of the Korean Constitution.
However, in the decision the Court gave no logical 'demonstration' of any discrimination between men and women. Instead, it jumped straightforward to declare that the Provision constitutes a discrimination, based merely on its written words.
If we are to follow the paradigmatic doctrine, which the precedents of the Court still hold onto, that says the Equality Clause of the Constitution (Art. 11. sec. 1.) dictates the legislature to treat the people by the rule 'likes alike, unlikes unalike', we would necessarily have to (1) elucidate the principle of how to distribute the burden of military service, and (2) make inquire whether, in accordance with the above principle, the amount of military burden distributed to each man is commensurate with his qualities. Since each man differs in his qualities without exception, the amount of value or burden that he takes must also differ, no one taking the same amount.
Whereas, the 2nd sentence of Art. 11. Sec. 1. of the Constitution proclaims that 'gender, religion, or social status' cannot function as the criteria of distribution. The above sentence is commanding that the people shall be treated equal in spite of his/her gender, in spite of his/her religion, and in spite of his/her social status.
Which means, the above sentence cannot be interpreted based on the dogma of 'likes alike, unlikes unalike'. And on the same line, a theory which cannot explain the 2nd sentence of the same section cannot be taken to explain the 1st sentence, either.
The Court's affirmation that the Provision is discriminating men from women is not consistent with the doctrine it had taken so far. The 2nd, not the 1st, sentence of Art. 11. sec. 1. of the Constitution should be taken as a dictation to the legislature. And the current dogma, namely that the above 1st sentence commands the legislature to treat people by the principle of 'likes alike, unlikes unalike', must be abandoned.
