시민사회와 주권국가에서 폭력의 통제논리에 관한 법사회학적 고찰 (A Study on the Legal Logic of Violence Control in Civil Society and Sovereign Countries)

초록

영어 nationalism을 국가주의, 민족주의 그리고 국민주의로 번역할 수 있듯이, nationalism은 세 가지 기본적인 의미와 내용 및 이 세 가지 개념을 모두 표현하고 있다고 가정할 수 있다. 이 점을 포함해서 본고에서는 우선 여러 논자들의 nation 개념의 역사에 대해 논의하였다. 이전의 연구는 정통폭력의 편재 상황에서의 이탈의 역사를 일방적으로 폭력의 독점자로서 근대국가의 성립을 논하는 반면에 본고에서는 폭력이 배제된 시민사회의 성립과 동시에 이를 병행적 과정으로 설명하였다. 하지만 시민사회와 국가와의 관계에 대해 너무 단순화된 도식은 우리에게 오해를 초래하고 그것이 현대 시민사회의 전개를 저해할 가능성이 있다. 그러므로 이 도식을 고려하여 nation을 현대 시민사회에 접속하고 그 안에서 폭력의 통제를 논할 수 있을 것이다.
어원적으로 라틴어의 societas civilis 또는 civitas, 그리고 고대 그리스어 koinonia politike에서는 물론 심지어 시민사회의 중요한 원천 중의 하나인 중세의 도시 내부에서도 그리고 자연상태와 (또는 폭정과) 대비된 문명사회의 정치적 질서가 갖추어져 있는 근대 시민사회에서도 폭력의 제한은 그 중심 주제였다.
시민사회는 서구 정치사상사 속에서 기본적으로 폭력을 제어된 사회영역으로 포함시킨다는 거의 일관된 의미를 가지고 이해하여 왔다. 시민사회는 급기야 분쟁해결 및 관리를 위한 포럼 개최와 의식적인 이의와 토론, 미디어 및 이벤트를 이용한 토론관계의 구축, 글로벌 거버넌스의 개혁 등을 통해 정부와 국제기구에 대해 영향력을 행사하거나 또는 국가를 매개하지 않고 직접 당사자끼리 시민사회에서 논의하고 교류함으로써, 분쟁해결 및 평화구축에 기여해야 한다는 생각을 모아나가고 있다. 그런데 국가에 의한 법적 보호와 그 집행을 담보하는 폭력의 독점 자체는 역사적 성취로서 중요하다는 것은 말할 필요도 없지만, 그 시각에서만 현실을 보는 것은 너무 단순하다. 이 상황에서 폭력의 관리나 제어는 시민사회 개념의 이론적 전개에서 중심적인 주제로 계속 논의되어 왔다. 이와 동시에 전쟁과 폭력의 복잡하고 치열한 교차 속에서 사람들의 행위는 그들이 표현한 대로 이해해야 한다. 그리고 이 행위는 ‘테러와의 전쟁’이라는 끝없는 싸움을 선언한 헤게모니 국가가 존재하는 현재도 진행되고 있다. 본고는 시민사회와 주권국가에서 폭력의 통제논리가 어떻게 전개되고 있는지 제시하였다.

영어초록

Civil society has been understood in a coherent sense to include basically violence as a controlled social domain in Western political history. In addition to holding forum for dispute settlement and management, we have the power to influence the government and international organizations through conscious protest and debate, building discussion with media and events, reforming global governance, and there is growing consensus through discussions and exchanges among civil society in the parties, it is thought that they should contribute to conflict resolution and peace-building. However, it is needless to say that the monopoly of violence, which guarantees legal protection by the state and its enforcement, is important as a historical accomplishment, but it may be too simple to see reality only from that point of view. In this context, the management and control of violence has been discussed as a central theme in the theoretical development. At the same time, it must always be understood as an expression of people’s actions in a complex and intense intersection with the world of war and violence. And this act is still going on in the presence of a hegemonic state that declared an endless battle of ‘war on terror.’ In the medieval city of the city, which is one of the important sources of civil society, as well as in the societas civilis or civitas in the Latin language, and in the ancient Greek koinonia politike, and also in the political order of the civilized societies, the limitation of violence in the modern civil society as a society was the central theme. Just as English word nationalism can be translated into various ways it can be assumed that nationalism represents all three basic meanings and contents and all three concepts. I have already discussed the history of the nation concept of several authors, including this point. The history of departure in the previous ubiquitous situation of orthodox violence can be explained as a parallel process at the same time as the formation of a civil society without violence, while discussing the establishment of a modern state as an orthodox monopolist of violence unilaterally. But the simplistic schemes of the relationship between civil society and the state are misleading us and may hinder the development of modern civil society. Therefore, considering this scheme, we can connect the nation to modern civil society.
