이 논문은 『청명집』의 판례를 통해 남송 시기 지방관이 이혼 소송을 다룰 때 보인 공통된 경향을 찾아 그 의미를 고찰한 것이다. 지방관은 더 이상 부부관계를 유지할 수 없다고 판단했을 때는 부부간 ‘의(義)’가 끊어졌다며 이혼을 명하고, 아내의 간통, 도망, 절도에 대해서는 ‘청종부의(聽從夫意)’로 처리했으며, 화리(和離)에 대해 이혼서의 효력을 중시했고, 여자 쪽의 이혼제기에 대해서는 합의를 위해 중재자를 자처했다. 이로써 당시 이혼 소송의처리 경향이 당률의 의절(義絶), 칠출(七出), 화리의 범위 속에 있으면서도, 그 구체적 실천에서 그것의 변용과 확장을 확인할 수 있다. 부부 당사자의 의와 정을 강조한 것, 칠출의 정신이 남편에 대한 규제가 아닌 관의 개입에 대한 규제로 실천된 것, 화리에 대해 관이 개입할 수 없음을 강조한 것, 중재자로서 지방관의 역할을 중시한 것 등은 당대와 다른 부부 중심의 소가족 형태인 송대 가족문화를 반영한 것이며, 이혼 소송이 부부(양가)의 의사나 관계를 중시하는 방향으로 처리된 남송 사법 문화의 특징을 알 수 있다.

영어초록

The purpose of this paper is to find commonalities among the divorce cases that local officials from the Southern Song period encountered by analyzing divorce cases from the Qingmingji淸明集. We considered the implications of the commonalities and found that there are finite patterns in the local officials’ judgements from this period. When they determined that a couple could not sustain a marital relation, they allowed divorces by stating that ‘Yi(義)’ between the couple had been broken. In the case of the wife’s misdeeds such as infidelity, flight, or theft, they allowed the husband to make the decision regarding the divorce. In the case of mutual agreement, they fully understood that the bureaucracy had limited power to intervene and upheld the divorce agreement. In the case where the wife’s family filed for divorce, they actively played the role of the mediator in order to bring both parties to an agreement. Therefore, the way disputes between marital couples were discussed and handled were within the boundaries of ‘Yijue(義絶)’, ‘Qichu (七出)’, and ‘Huali(和離)’ of the Tang Code. At the same time, however, we can confirm that the actual methods of execution and discussion of divorce have changed and expanded from Yijue(義絶), Qichu(七出), and Huali(和 離). Through these changes and expansions, we see the impact of the changes in family culture, where smaller family units became more prevalent during the Song Dynasty in comparison to that during the Tang Dynasty. Furthermore, we see the local officials respecting the changes in family culture. In the case of individual disputes between the couples, we can observe how the judicial culture of the Southern Song period dictated that they must try to respect the opinions or the relationships of the couples (or their families) as much as they can.
