환경분쟁관리의 권위적 방식과 대안적 방식에 관한 비교사례 연구: 프랑크프르트 공항 활주로 건설과정을 중심으로 (Administrative decision and ADR of Environmental Disputes)

초록

환경분쟁의 특징은 현재 발생한 문제가 미래의 문제이기도 하다는 것이다. 문제는 미래 환경에 대한 영향 평가가 현재 알지 못할 수 있는 지식을 요하는 고도의 전문적 영역에 속한다는 점이다. 현재 한국의 경우 대부분의 환경분쟁이 일방적 행정 결정이나 법원에서의 결정을 통한 해결이 다수를 차지하고 있고 그 결과 끊임없는 분쟁을 야기하고 있다. 또한 관련 전문가의 의견이 왜곡되거나 편향됨으로 인해 분쟁을 촉발하는 요인으로 작용하고 있다.
독일 프랑크푸르트공항 건설의 경우는 동일한 사안에 대한 시차는 있지만 대응 내지는 해결하는 방식의 차이에 따라 나타난 결과는 매우 큰 차이가 난다는 것을 보여주는 예이다. 80년대의 행정부에 의한 일방적인 결정과 밀어붙이기식의 공항 건설은 환경론자들뿐만이 아닌 일반 시민들의 엄청난 반발을 불러왔다. 당시 전쟁 상황에 준하는 갈등양상은 시간적으로 약 15년에 걸쳐서 한화 3천억 원에 달하는 비용과 2백만이 넘는 데모진압 인원이 투입된 매머드급 공공분쟁이었다. 또한 공항 활주로 건설과 관련된 백 여건의 소송이 있었고 수많은 시위대와 경찰이 충돌하여 두명의 사망자와 많은 부상자가 발생하였다.
이와 달리 90년대 말 동일한 장소에서 추진된 프랑트푸르트공항 북활주로의 건설은 그 해결을 위해 ADR방식을 도입하고, 수많은 논쟁과 토론을 하였으며 많은 전문가들의 평가를 바탕으로 한 중재안을 제시하였고, 분쟁 당사자들이 중재안에 대한 합의에 도달함으로써 다음과 같은 효과를 창출하였다. 첫째, 법원에서 소용되는 시간과 많은 경비를 절감할 수 있었으며 둘째, 건설론자와 반대론자간의 물리적인 충돌을 피할 수 있었으며 셋째, 행정부와 지역주민간의 대화채널을 제도화할 수 있었으며 넷째, 중재안에 도달하기까지 공항건설과 관련된 환경문제에 대한 많은 지식을 축적할 수 있었다. 사태의 해결까지 약 1년 반의 시간이 소요되었고, 비용은 6백50만 마르크(한화 약 40억원)이 소요되었다. 합의에 이르기 위해 소음 및 공항 건설에 따른 주변 주민들에 대한 생태학적, 환경적 연구를 통해 많은 전문적인 지식을 축적할 수 있었고, 경제적 연구를 통해 6만이 넘는 공항 관련 고용 창출 효과를 기대할 수 있다는 등 주변 주민들에게 미치는 영향을 연구하였다. 이 결과를 토대로 활주로 건설에 따른 생태학적인영향과 경제적인 영향에 대한 객관적인 평가 기준을 제시하여 주민들이 직접 판단이 가능하도록 함으로써 결정 이후의 반발을 최소화하였다.
환경분쟁은 정확한 원인규명과 영향 평가가 해결의 핵심사항이라 볼 수 있다. 원인규명은 해당 분쟁의 해결을 위한 전제가 되기도 하지만, 앞으로 발생할 분쟁의 정보창고의 역할도 가능하다. 또한 환경문제를 계획수립단계에서부터 해당 지역 주민들의 직접적인 참여를 유도하면 분쟁해결에 많은 도움을 받을 수 있다. 특히 환경분쟁은 지역주민과 지자체 내지는 국가가 분쟁당사자인 경우가 많으므로 전문적인 조사 내지는 여론 조사 또는 주민투표제를 적극적으로 활용할 필요성이 있다.

영어초록

One of features of environmental disputes is that people place emphasis on the issue that will bring about problems in the future while fighting over the current problems. Future environmental impact assessment requires advanced expertise knowledge.
In Korea, most of environmental disputes are currently worked out through an administrative unilateral decision or the courts, which causes constant disputes. In addition, biased or distorted opinions of the related experts are also the causes of the disputes.
An example of Frankfurt Airport in Germany showed that the results of the same issues could vary depending on the methodsof dealing with the problem. Frankfurt airport construction, which was unilaterally decided and carried out by the government in the 1980’s, brought about a strong opposition by not only environmentalists but also the ordinary citizens. That was a great public dispute compared to war situation, so that amount at costs reaching 100 billion won was invested and more than 2 million people were involved for 15 years.
And about 100 suits relating to runway construction were filed,and two people were killed and numerous people were wounded in clashes between the protesters and the police.
On the other hand, when the north runaway, which was constructed at the same place in the 1990s, was planned in the Frankfurt Airport, an ADR method was introduced and lots of debates and discussions were held for settlement. A mediated settlement based on evaluation of experts was presented and the parties in the dispute at last reached an agreement.
First, time and money required for suit were saved. Secondly, clashes between the police and the protesters were avoided. Thirdly, channels of communication between administration and local residents could be institutionalized. And fourthly, knowledge on the environmental issues relating to airport construction could be considerably accumulated. Approximately 6.5 million marks (about 4 billion won) were invested for about a year and a half for settlement.
In order to come to an agreement, they carried out ecological and environmental researches on the neighboring residents with regard to airport construction and noise, and thus could accumulate lots of professional knowledge. Plus, economic researches they conducted showed the employment effect of the airport on the local people, which would produce more than 60,000 jobs. Like this, based on a lot of researches, they presented objective valuation criteria on ecological and economic effects, so that the local people could judge for themselves and the resistance of them could be minimized.
The key to solving the environmental disputes is to thoroughly investigate the causes of the dispute and evaluate the impact. Investigation of the causes is not only the premise of the settlement of the current dispute but also will play a role of an information warehouse for the future issues.
And if the participation of the local people is induced in the planning stage, it will be helpful in solving environmental disputes. Especially in most cases of the environmental disputes, local people, local government or the government are the parties to the dispute. Therefore, professional researches, public opinion poll or resident referendum should be actively utilized.
