초록

오늘날 우리 사회의 화두는 AI(Artificial Intelligence)이다. 이제 우리 사회는 AI없는 세상을 상상하기 조차 매우 어려운 사회적 환경 속에 살고 있다. 우리의 생활패턴 자체가 AI와 연결되어 있기에 작금의 시대를 AI시대라고 할 수 있다. AI시대는 인간과 AI가 공존 내지 공생하는 시대이다. 그렇다고 하여 인간과 AI의 관계는 동등할 수 없다. AI는 인간의 편의성을 위하여 생활보조적 도구로 개발되었기 때문이다. 따라서 인간과 AI의 관계는 주된 인간과 이에 부수되어 종된 AI 관계로 설정되어야 하며, AI시대를 맞이하여 영원불변한 인간우위의 절대원칙을 확립하여야 한다. 인간은 세상의 그 어떤 개체들보다 절대우위에서 존재하는 인격체이다. 설령 AI가 인간의 능력을 초월하게 되는 상황이 다가오더라도 AI는 인간이 발명한 피조물에 불과하며, 인간은 AI가 근접할 수 없는 인간 고유의 정신세계를 갖고 있기 때문이다. 인간 고유의 정신세계에 존재하는 실천이성과 형법적 도덕률은 도덕과 형법의 경계선에서 인간에게 도덕성을 강화하여 인간을 실존케 하는 유용한 형법사상이 될 수 있다. 이와 관련하여 실천이성은 도덕법칙에 근거한 인간의 행위로서 도덕적 명령에 의거하는 이성적 실천력이고, 형법적 도덕률은 형법적 가치를 가지는 도덕법칙이라고 할 수 있다. 다시 말하자면, 실천이성은 도덕적 판단을 바탕으로 인간에게 합리성을 갖도록 하는 것이고, 형법적 도덕률은 일종의 도덕적 명령으로써 인간에게 도덕적 행위를 이행하도록 하는 것이다. 그래서 양자는 인간의 내적 판단기준에 공통되는 도덕법칙을 내포하고 있기에 인간다움의 정신세계를 관장하는 결정체로서 상호불가분의 관계성을 가진다. 따라서 AI시대를 맞이하여 인간에게 더욱 필요한 것은 무엇보다도 인간의 정신세계를 올바르게 인도하는 형법사상의 함양이다. 즉 실천이성과 형법적 도덕률은 우리 인간에게 도덕성을 강화할 수 있는 실용적인 도덕사상이며, 동시에 매우 유용한 형법사상이기에 AI를 합리적으로 통제할 수 있다. 무엇보다도 실천이성과 형법적 도덕률은 도덕법칙을 바탕으로 합법성, 공정성, 도덕성을 추구한다. 그래서 양자는 주지하는 바와 같이 도덕적 명령에 의한 도덕적 행위를 추구하므로 향후 AI범죄를 예방하는 형법사상으로서 타당하다고 할 수 있다.

영어초록

The topic of today's society is artificial intelligence (AI). Nowadays, our society is enveloped in a social environment making it increasingly challenging to imagine a world without AI. The current era can be appropriately labeled as the AI era due to the interconnectedness of our lives with AI. The AI era is an era in which humans and AI coexist. However, the relationship between humans and AI cannot be considered equal. This is because AI was developed as an auxiliary tool for the convenience of humans. Therefore, in the era of AI, the relationship between humans and AI should be established as one where AI is subordinate to humans, ensuring the enduring principle of human advantage. Human beings possess personalities that are inherently superior to those of any other individuals in the world. Despite the possibility of AI surpassing human capabilities, it is important to remember that AI remains a human creation, and humans possess a distinct mental realm that AI cannot emulate. The practical reason and criminal law of morality, which exist in the human mental world, can serve as useful tools or concepts that reinforce moral standards among individuals, acting as a boundary between morality and criminal law, thereby promoting their coexistence. In this regard, practical reason is a human act that is grounded in moral laws and functions as a rational practical power guided by moral commands. Additionally, criminal law encompasses moral legislation with an emphasis on criminal consequences. In other words, practical reason aims to make humans rational by guiding their moral judgments, while the criminal law of morality intends to ensure that humans engage in moral behavior by issuing moral commands. Therefore, due to both embodying moral laws that are commonly used in human internal judgment criteria, they share an inseparable relationship, functioning as crystals that govern the mental world of humanity. Therefore, in the era of AI, what humans need most is the cultivation of a criminal law ideology that accurately guides the human mental world. In other words, practical reason and the criminal law of morality encompass practical moral ideas that can enhance human morality and serve as a valuable criminal ideology, thereby enabling reasonable control of AI. Above all, practical reason and criminal law seek legitimacy, fairness, and morality grounded in moral principles. Therefore, as is well known, both endeavor to promote moral behavior through the imposition of moral order, making it valid to consider criminal law ideology as a means to prevent AI crime in the future.
