유료방송플랫폼사업자와 홈쇼핑채널사업자간 송출수수료 적정성에 관한 법경제학적 분석 (An approach of Law and Economics on the Adequacy of Transmission Fee between Pay Broadcasting Platform and Home-shopping Channel operators)

초록

본 연구는 홈쇼핑채널거래시장에서 송출수수료가 결정되는 메커니즘에 대한 실증적인 분석을 토대로 현행법 상 홈쇼핑송출수수료의 적정성 판단 기준의 적합성과 금지행위 위반 가능성에 대한 법・경제학적 고찰을 수행하였다.
홈쇼핑송출수수료와 방송사업매출, 영업비용, 채널 등급별 홈쇼핑채널송출수, 채널 등급별 가입자수 간의 상관관계를 분석한 후, 홈쇼핑송출수수료에 영향을 미치는 결정 요인을 검증하였다. 분석 결과, 전년도 방송사업매출, 영업비용, 아날로그 및 디지털 S등급 송출채널 수, 아날로그 S 및 A등급, 디지털 S 등급 가입자수와 홈쇼핑송출수수료 간에는 정적인 상관관계를 보였으며, 이 가운데 홈쇼핑송출수수료에 직접적인 영향을 미치는 요인은 전년도 홈쇼핑방송매출액, 디지털 상품 S등급 송출채널 수, 전년도 홈쇼핑방송매출액 대비 송출수수료 비중이 유의미한 요소로 밝혀졌다. 그러나 현행법상 ‘홈쇼핑 방송채널 사용계약 가이드라인’에서 적시하고 있는 기준(제8조 제3항)은 현저히 불리한 거래조건 여부를 판단하는 기준으로 홈쇼핑송출수수료 산정시 고려요소는 될 수 있으나 적정성을 판단하기에는 미흡한 점들이 발견된다. 방송사업자의 수익구조, 상품 판매 매출의 증감, 방송사업 매출 증감, 물가상승률 등 이러한 판단 기준이 선언적 수준의 예시는 될 수 있으나 적정성 수준에 대한 판단은 어렵다. 또한 실증적 분석 결과에서 보여주고 있는 송출채널 등급도 가이드라인에는 배제되어 있다.
규제기관은 홈쇼핑송출수수료의 적정성 판단을 위한 기준을 제시하는 것도 중요한 정책 과제 중 하나이지만 현 규제체계의 실효성 진단과 더불어 홈쇼핑송출수수료의 인상으로 인한 유료방송시장에 미치는 영향에 대한 검증이 선행될 필요가 있다. 자칫 정부의 규제가 역으로 소비자 후생을 저하시킬 수 있기 때문에 경제적 효율성과 소비자 후생 간 형량도 신중을 기해야 한다.

The purpose of this study was to examine legal economics of the suitability of the criteria for determining the adequacy of home shopping transmission fees and the possibility of illegality in prohibited acts based on empirical analysis of the mechanism for determining the transmission fees in the home shopping channel transaction market.
As a result of analysis, there was a positive correlation between the previous year's broadcasting business sales, operating expenses, the number of analog and digital S-class transmission channels, the number of analog S and A-class, digital S-class subscribers, and the home shopping transmission fee. The factors that have a direct influence were found to be significant factors such as the amount of home shopping broadcasting sales in the previous year, the number of S-class transmission channels for digital goods, and the proportion of transmission commissions compared to the previous year's home shopping broadcasting sales. However, the current standards in the “Home Shopping Broadcast Channel Usage Agreement Guidelines” are criteria for judging whether or not the transaction conditions are significantly unfavorable, but may be considered as a factor in calculating the home shopping transmission fee. These criteria, such as the profit structure of broadcasters, the increase and decrease in sales of products, the increase and decrease in broadcast business, and the inflation rate, can be examples of declarative levels, but it is difficult to judge the appropriateness level. Also, the outgoing channel ratings shown in the empirical analysis results are excluded from the guidelines.
It is one of the important policy tasks for the regulatory agency to provide a standard for determining the adequacy of the home shopping transmission fee, but it is necessary to conduct a diagnosis of the effectiveness of the current regulatory system and to verify the impact on the paid broadcasting market due to the increase in the home shopping transmission fee. There is. Because government regulations can adversely affect consumer welfare, economic efficiency and the amount of money between consumer welfare must also be considered carefully.
