하수도 사용료에 대한 공법적 고찰 (A study on the Sewage Use Fee from a public law perspective)

초록

하수도는 하수를 수집, 수송, 처리, 방류하는 일련의 하수도시스템을 말한다. 인간이 위생의 중요성을 인식하면서부터 하수도의 보급이 시작되었고, 현재 전국의 하수도 보급률은 약 94%에 이르고 있다. 하수도는 하수의 적정 처리를 통해 침수 피해의 예방, 공중위생의 향상과 공공수역의 수질을 보전하는데 기여하고 있다. 오늘날 하수도는 지역 주민의 생활에 필수적인 공공재에 해당하며, 지방자치단체가 제공하는 하수도서비스는 필수 공공재의 공급을 목적으로 하는 공공서비스에 해당한다. 하수도 사용료는 공공하수도의 이용에 대한 대가로 그 시설의 유지 및 관리에 소요되는 비용을 수익자부담의 원칙에 따라 공공하수도의 사용자가 부담하고 있다. 그러나 현실에서는 하수도서비스가 지방자치단체의 행정서비스로 인식되면서 하수도 사용료의 산정과정에 하수도서비스의 계속성을 유지할 수 있는 비용이 충분하게 반영되지 못하거나, 그 결정에 관여하는 지방자치단체의 장이나 지방의회가 정치적 이유로 하수도 사용료의 인상에 소극적으로 대응하고 있어 요금 수준이 원가에 이르지 못하고 있는 상황이다. 하수도 사용료가 1983년부터 징수되고 있음에도 불구하고 요금현실화율은 전국 평균 약 46%에 그치고 있어 하수도 재정은 여전히 열악한 상태에 놓여 있다.
국민의 삶의 질이 향상되면서 하수도서비스에 대한 요구수준은 더욱 높아지고 있다. 과거에는 단순 하수의 배제에 그쳤다면, 현재는 하수처리의 고도화, 악취 제거, 노후화된 공공하수도의 적정한 관리까지 요구되고 있다. 결국 변화하는 요구에 능동적․선제적으로 대응하기 위해서는 하수도 사용료의 적정화와 현실화가 필요하다. 하수도서비스를 이용하는 자가 그에 합당한 가격을 지불하는 것은 오염원인자부담의 원칙에도 부합하며, 지속가능한 하수도서비스의 제공을 위한 재원 마련과 미래세대를 위한 물자원의 보호에도 기여할 수 있기 때문이다. 하수도 사용료의 적정화와 현실화를 위해서는 현행 하수도 사용료의 결정체계와 부과․징수체계에 대한 검토가 필요하다. 하수도 사용료의 결정체계에 있어서는 사용료 결정의 절차적 정당성을 확보하고 낮은 하수도 사용료의 현실화를 위한 전제로서 총괄원가 산정에 대한 검토가 필요하다. 하수도 사용료의 부과․징수체계에 있어서는 부과대상을 명확하게 하고, 감면 대상의 불명확성을 해소하며, 이의신청절차의 실효성이 확보될 수 있도록 하는 등 절차적 보완이 필요하다. 현재 하수도 설치 및 관리사무는 자치사무에 해당하여 하수도 사용료에 관한 상당 부분이 지방자치단체의 조례로 정해지고 있다. 하수도 사용료와 관련된 절차적 사항의 보완은 조례의 개정을 수반한다는 점에서, 결국 자치입법권 행사에 있어 지방자치단체의 전문성 확보 등 지방자치의 성숙성이 요구된다.

A sewerage system means a set of sewer systems that collect, transport, process and discharge sewage. Since humans recognized the importance of hygiene, sewerage system began to be supplied, and the nationwide supply rate of sewage has reached about 94%. Sewerage is contributing to the prevention of flood damage, improvement of public hygiene and preservation of water quality in public waters through proper treatment of sewage. Today, sewerage comes under a category of public goods that is essential for the lives of local residents, and public services provided by local governments aiming to supply essential public goods. Sewerage Use Fee is the cost of maintenance and management of the facility borne by the user of public sewerage system according to the principle of beneficiary-pays principle in return for the use of public sewage system. However, in reality, the cost of maintaining the continuity of the sewer service is not sufficiently reflected in the calculation process of the sewerage fee, or the head of local governments or local councils involved in the decision are responding passively to the increase of the sewerage fee for political reasons, because the sewer service is recognized as the administrative service of local governments. Despite the sewerage fees has been collected since 1983, the charge realization rate is only about 46% nationwide, and so the finances of sewerage are still in a poor state.
As the quality of life of the people is improved, the demand level for sewage service is increasing. In the past, sewage service was just for a simple removal of sewage, but it is now required to improve sewage treatment, remove odor, and manage the aged public sewage properly. In the end, in order to respond actively and preemptively to changing demands, it is necessary to optimize and realize the sewage fee. The reason why the person who uses the sewer service should pay the appropriate price is because it corresponds to the polluters pay principle and can contribute to the financing for providing sustainable sewer service and protecting water resources for future generations. In order to optimize and realize the sewage fee, it is necessary to review the determination system and the imposition and collection system of the current usage fee. In the decision system of sewage fee, it is necessary to review the calculation of the full cost as a premise to secure the procedural legitimacy of deciding use fee and to realize the low sewage fee. In the imposition and collection system of sewage fee, procedural supplementation is needed such as clarifying the target for charge, eliminating the uncertainty of the subject to exemption, and securing the effectiveness of procedure for raising an objection/appeal. Currently, the installation and management of sewerage come under Autonomous Affairs, and a large part of sewage fee is decided by the ordinance of local governments. The supplementation of procedural matters related to the sewage fee involves the revision of municipal ordinance, and eventually, the maturity of local autonomy is required, such as securing the expertise of local governments in the exercise of autonomous legislative power.
