초록

세속화된 오늘날, 종교 다원주의와 문화다양성이 확산되고 있는 시대에서 우리 모두가 어떻게 평화롭게 공존할 수 있는가는 매우 중요한 문제이다.
종교는 역사적으로 국가의 영역으로부터 사회와 시민의 사적 영역으로 점차 밀려나고 국가는 종교의 영향으로부터 벗어나 세속화되었다. 이렇게 함으로써 국가와 공공질서는 시민들을 포용하는 새로운 보편적인 헌법적 기반 위에 세워질 수 있었다. 종교는 국가질서의 구성요소에서 벗어나고 국가는 다양한 종교적 신조에 대하여 중립적 입장을 취하게 되었다.
한 개인은 무엇을 믿든지 믿지 않든지 자유로워야 하고, 국가는 개인의 신앙의 자유를 보장해 주어야 하며 다양한 종교적 신념에 대하여 중립적이어야 한다. 역사는 개인의 양심에 의존하는 종교의 자유를 무시하고 세속에서 특정 종파의 교리를 획일적으로 적용시키면서 다른 신념과 교리에 대해서는 세속권력을 등에 업고 불관용적이었던 시기가 많았음을 잘 보여주고 있다.
종교적 다원주의 하에서 반드시 필요한 중립과 관용은 헌법적 유연성에서 비롯될 수 있다. 미연방수정헌법 제1조를 살펴보면 의회는 어떤 종교도 편애해서는 안 되지만 동시에 자유롭게 자신의 종교적 믿음을 실천할 수 있는 권리도 보장하고 있다. ‘국가가 하나의 종교만을 인정하지 않는다는 것’과 ‘종교적 자유가 광범위하게 인정된다는 사실’은 국가와 종교의 관계에 있어 이상적 조건을 만들어 주었으며, 사람들이 자유롭게 이 종교에서 저 종교로, 하나의 종교에서 다른 종교로 이동하는 분위기 속에서 종교는 서로 경쟁하면서 진화할 수 있게 되었다. 즉, 종교가 개인의 고정된 특징이라기보다는 개인적 선호의 대상으로 인식되어야 사회와 정치적인 갈등으로부터 벗어날 수 있다. 그러므로 특정 종교 공동체에 매몰되어 고립되는 것이 아니라 타 종교인 또는 무종교인들과 함께 살고, 일하면서 자신과 다른 종교의 사람들을 받아들여야 할 필요가 있으며, 이를 위해 종교 간 교류는 반드시 필요한 일이다.
현대사회의 다원주의로부터 야기되는 합리성의 위기는 곧 의사소통의 위기로 이어지며, 의사소통의 위기는 결국 인간존엄성의 보편성 위기와 인권유린으로 이어진다. 의사소통의 문제, 합리성의 문제를 해결하기 위해 종교･문화 간의 대화를 하는데 있어 인간존엄성은 전제 조건이자 일차적인 관문이 된다. 인간의 존엄성 보장은 모든 국가권력과 국가목적에 우선하며, 이를 보호하는 것이 국가의 가장 중요한 과제이다. 국가는 인간을 위해서 존재하는 것이지, 인간이 국가를 위해서 존재하는 것은 아니다. 인간존엄성은 인권과 관련된 국제규약이나 인권선언뿐만 아니라 법체계 내에서 조문과 판결 속에서도 발견되지만, 중요한 것은 종교적이거나 세속적인 사람 모두가 받아들일 수 있는 합의와 중재의 공론장이 된다는 점이다.
우리헌법의 종교적 기본권 해석과 적용에 있어서도 종교에 대한 유연성은 반드시 필요하다고 생각된다. 이를 위해서는 다원주의적 문화의 가치를 발견해 나가면서 한편으로 자신이 믿는 종교와 타종교 간 상호 존중에 따른 관용으로 조화로움을 이뤄야 한다. 그러한 종교와 헌법 간 조화로움의 근거로는 인간존엄성의 사상이 될 수 있다.

영어초록

In today's secularized world, how we can all coexist peacefully in an era of spreading religious pluralism and cultural diversity is a very important matter.
Religion has historically been gradually relegated from the realm of the state to the private sphere of society and citizens, and the state has been secularized away from the influence of religion. In doing so, the state and public order could be built on a new universal constitutional basis that embraces citizens. Religion was removed from a component of state order and the state took a neutral position on various religious creeds.
An individual must be free to believe or not, the state must guarantee his or her freedom of faith and be neutral to various religious beliefs. History clearly shows that there were many times when different beliefs and doctrines were unconcerned with secular power while ignoring the religious freedom that depended on individual conscience and applying uniformly applying the doctrines of certain sects in the world.
Neutrality and tolerance, which are essential under religious pluralism, can result from constitutional flexibility. Looking at the First Amendment, Congress should not favor any religion, but at the same time it also guarantees the right to freely practice its religious beliefs. “The fact that the state does not recognize only one religion” and “the fact that religious freedom is widely recognized” have created ideal conditions for the relationship between the state and religion, enabling religions to evolve from one religion to another in an atmosphere where people are free to move from one religion to another. In other words, religion should be perceived as an object of personal preference rather than a fixed characteristic of an individual to escape social and political conflict.
Therefore, it is necessary to live with other religious people and accept people of different religions while working, rather than being trapped and isolated by certain religious communities, and to do so, interreligious exchanges are essential.
The crisis of rationality caused by pluralism in modern society soon leads to the crisis of communication, which in turn leads to the crisis of universality of human dignity and human rights abuses. Human respect is a prerequisite and a primary gateway to dialogue between religions and cultures to solve the problem of communication, the problem of rationality. Ensuring human dignity takes precedence over all state power and national purposes, and protecting them is the nation's most important task. A nation exists for man, not for man. Human dignity is found not only in international treaties or human rights declarations related to human rights, but also in the process of condolence and judgment within the legal system, but what is important is that it becomes a public forum of agreement and mediation acceptable to both religious and secular people.
It is also thought that flexibility in religion is necessary in the interpretation and application of the religious fundamental rights of our constitution. In order to achieve this, the government should discover the value of pluralistic culture and, on the other hand, reconcile it with the tolerance of mutual respect between religion and other religions that it believes. The basis of such harmony between religion and constitution can be the idea of human dignity.
