주역과 현대정치철학의 정의론 (I-Ching and Justice in Contemporary Political Philosophy)

초록

이 글은 주역의 원리에 입각하여 현대 정치철학에서 논의되고 있는 정의론을 조명해 보는 것을 목적으로 한다. 현대 정치철학에서 특히 자유주의적 정의관은 개인의 자유와 권리를 강조함으로써 개인을 사회로부터 고립시키게 된다. 이러한 자유주의적 정의관의 문제를 지적하고 개인과 사회의 연루성과 공동선의 중요성을 강조하는 현대공동체주의 정의관이 등장한다. 한편 개인과 사회의 연루성을 민족성이나 인종문화적 정체성에 초점을 맞추어 소수민족이나 인종문화적 집단에 특별한 집단차별적 권리를 주장하는 다문화주의 정의관이 등장한다. 그러나 이러한 이론적 입장들은 공통적으로 인간과 사회를 우주자연의 질서나 목적성으로부터 분리시키고 있다. 정의 문제가 궁극적으로 인간의 좋은 삶과 행복의 실현 문제라면, 인간과 사회를 우주자연의 질서나 원칙과 결부시켜 파악하는 시도가 보다 절실히 요구된다.
주역은 인간, 사회, 자연의 삼자 관계를 유기적으로 파악하여 인간 삶의 생존 논리를 총체적으로 표현해 낸다. 그것은 자연 및 우주질서의 논리를 인간행위 및 사회운영의 논리와 연결시키고자 한다. 이러한 주역의 입장은, 개인 상호간의 신념의 차이나 또는 공동체 상호간의 정의관의 차이가 발생하였을 때, 이것을 자연 또는 우주와 연관한 인간 삶의 본질과 목적성에 비추어 판단할 수 있는 반성의 기회를 제공해 준다. 특히 음양론은 우주자연의 질서와 인간사를 연결시키고 있는 핵심적 논리이다. 음양론의 교역과 변역, 그리고 잠재적 전환성의 원리는 개인이 지니는 정의감 및 도덕준칙, 그리고 공동체의 정의 및 도덕 원칙을 자연의 질서와 연관한 인간 삶의 궁극적 본질에 비추어 평가해 볼 수 있는 실마리를 제공한다. 그리고 그것은 하나의 고정된 원칙에 집착하기 보다는 그 원칙의 해석의 융통성, 상황과 시의에 적합한 해결책을 모색할 것을 요구한다. 주역의 정의관은 자연과 우주의 질서원리에 입각한 자연적 정의로서 사람들의 일상적 생활을 통해 표현되는 삶의 원칙이다. 이러한 삶의 정의관은 공적인 정치적 원칙은 물론 우리가 하나의 신념으로서 가지고 있는 도덕관을 성찰할 수 있는 근거가 된다.

영어초록

This paper is aimed at reviewing theoretical debates on justice in comtemporary political philosophy in light of the Yin-Yang theory in the Book of Change. Specifically contemporary liberal conceptions of justice begin with the priority of individual freedom and liberty, thus ignoring the relationship of individuals and community. As a response to this liberal separation of individuals and society, contemporary communitarians attempted to restore the relationship between individuals and society in theorizing justice, which triggered the liberal-communitarian debates. And also we see another line of approach, that is, multiculturalism, which attempts to connect individuals to the membership of particular society or cultural community, specifically focusing on national minorities or ethnic groups. By emphasizing the importance of nationality or ethnicity in shaping the identity of individuals, it advocates the politics of group- differentiated rights. However, it seems that contemporary debates on justice fail to take seriously the relationship between human beings and nature in theorizing justice.
The Book of Change attempts to induce basic principles for society and individuals by identifying the fundamental principles of nature and universe. It sees the Yin-Yang interaction as the fundamental principle of nature and universe. It grasps the Yin-Yang as the fundamental cause of change and movement of the universe that keeps life of nature as well as human beings. That is, without the Yin-Yang interaction, there would be no change and movement, and further without change and movement, there would be no life. The Yin-Yang theory has been interpreted traditionally in two ways. One is the opposite interaction in space, which means that Yin and Yang interacts with each other in the opposite. The other is the changing interaction in time, which means that Yin and Yang interact with each other, producing the rise and decline of the two respectively. In addition to the two interpretations, I suggest the principle of potential conversion of Yin and Yang. That is, Yang involves Yin and vice-versa, which means that Yang in itself may converse itself into Yin and vice-versa.
The Yin-Yang theory runs through the universe, society, and human beings. First of all, this understanding of the fundamental connectedness of human beings and the universe should be the bedrock for theorizing public justice that most contemporary debates on justice are concerned with. Basically the Yin-Yang theory provides basic guidelines for managing society as well as leading individual life, which might be called common justice in daily life. This common justice, even if incomplete and open to various interpretations, may play a role of criticizing as well as complementing public justice which is also inevitably incomplete and unstable because of our incomplete capability of understanding, limited generosity towards others, and relative scarcity in resources.
