초록

본 논문에서 필자는 연암 박지원이 충청도 면천의 지방관으로 부임하면서 남긴 『七事考』의 청송(聽訟) 논의를 토대로 그의 형정론을 고찰하려고 한다. 박지원의 형정론은 한마디로 ‘주자학의 교화론을 갱신’한데 다름 아니었다. 교화가 우선이요 형벌은 마지못해 동원하는 수단이라는 덕주형보(德主刑補)의 원칙은 조선시대 일관되게 유지되었다. 이는 인간의 도덕 본성[性善]에 대한 주자학자의 깊은 신뢰 위에 구축된 정치 이념이었다. 연암 역시 근본적으로 주자학의 원칙을 벗어나지 않았다. 연암은 법을 지나치게 강조하기보다 정리(情․理)를 중시할 필요가 있다고 보았다. 물론 인정(人情)을 너무 앞세우면 법이 굽혀지므로 법과 정리의 시중을 얻는 것이 중요하다. 문제는 ‘시중(時中)의 지점’이 서로 달랐다는 점이다. 누구는 인정과 도리 보다 비교적 법의 엄격한 적용을 강조했다면 누구는 인정과 도리를 조금 더 강조했다. 연암은 부끄러움[恥]을 알게 하는 동시에 명예욕을 부추기는 방법을 통해, 즉 인정과 도리의 강조를 통해 질서를 유지하는 것만이 최선이라고 주장했다. 이러한 연암의 주장에 대해 세상을 위선자로 가득하게 만들 것이라는 반론 또한 적지 않았다. 하지만 박지원은 18세기 후반을 이미 군자를 기대하기 어려운 시절로 규정했다. 그는 어느 정도의 위선－대중의 욕망에 바탕한－은 사회가 감내해야 한다고 주장했다. 특히 도리와 生理[살려는 의지]가 갈등한 사건 판결에서 연암은 생리의 욕망을 어느 정도 수용함으로써 시대와 타협하고 있었다.

영어초록

Examined in this article is Park Ji-weon’s stance concerning the penal administration of the government. His such stance is well featured in Chilsago(七事考), a book that he wrote when he was serving as the prefect of the Chungcheong-do province’s Myeoncheon area. It also contain’s Park Ji-weon’s discussion of trials and lawsuits(聽訟), so that is what analyzed here in this article.
His ideas for an adequate penal administration was yet another take on the original Neo-Confucian notion of the said institution, which dictated that ‘enlightenment’ should be attempted first, and punishment should only follow later’ when all other options are exhausted. It dictated so in the spirit of ‘Benevolence should be considered as the main principle, while penal ruling should remain only as a supplementary approach[德主刑補]),’ a spirit which prevailed the entire Joseon period. This notion was nothing short of a political ideology that was based upon Neo-Confucians’ sincere trust of the human moral nature[“good will, 性善”].
Yeonam also shared that, so rather than placing too much of an emphasis upon the necessity of law, he argued that human emotions and situational circumstances(情․理) should be examined as well. Of course, too much indulgence in compassion(人情) would distort the spirit of the law, so a prudent assessment and appreciation of the situation(“Shijung, 時中”) was widely recognized as always required. Problem was the hard nature of determining a course of action, based on a supposedly ‘prudent’ analysis of the situation. Some might demand relatively strict implementations of the law, while some others might argue the importance of compassion.
Park Ji-weon argued that the latter approach, by forcing people to feel shame[恥] and encouraging them to listen to their sense of honor, would be the best way to maintain social order. Many people believed that such approach would lead to a society full of hypocrites, yet Park defined the second half of the 18th century as a time which could simply not expect noble men to rise and govern. He also argued that a level of hypocrisy, based upon public desires, should be tolerated to some extent, considering the circumstances. Especially regarding trial cases, which were essentially instances showing conflicts between morality and a ‘will to live[生理],’ Park Ji-weon generally supported the latter, displaying a compromise with the society and the time.
