교육환경의 다각화로 인한 교육주체에 관한 담론 (Discourse on educational subjects due to diversification of educational environment)

초록

디지털 대전환 시대는 기존 공교육에서 이루어진 표준화・획일화된 교육에서 벗어나 미래 핵심역량(6Cs)을 양성하는 교육으로의 전환을 요구하기 때문에 공교육의 한계를 인식하고 이에 대한 근본적 변화가 필요하다.
인간이 자유롭고 인간다운 삶을 향유하기 위해서는 교육을 통해 스스로의 잠재력을 이끌어 내어 시대에 부합하는 역량을 개발하고 강화하는 것이 필수불가결한 전제조건이다. 교육이 지닌 기능을 고려한다면 시대적 변화에 빠르게 대응하지 못하는 공교육제도의 한계의 문제는 계속하여 지적되었다. 특히 산업사회에서 요구된 획일화되고 정형화된 시스템에 적용할 수 있는 인간의 역량이 아닌 빠르고 다양하게 변화하는 지능정보화사회에서 요구되는 역량은 개별적이고, 산발적인 그리고 틀에 갇히지 않은 창의적인 역량이다.
지능정보화시대의 부합하는 역량을 갖춘 인재를 양성하기 위해서는 개별화되고 다양한 맞춤 교육이 필요하다는 사회적 요구가 강화되고 있다. 이에 대해서 본 논문에서는 시대의 변화에 선제적으로 대응하지 못하고 있는 공교육제도의 문제와 원인을 공교육제도하에서 이루어지는 의무교육 실현구조에서 찾아보고 관련 법규범을 분석한다. 이후 현행 헌법 제31조의 교육을 받을 권리의 실현이 교육을 통해서 지금, 우리사회가 요구하는 인재의 역량 강화로 연계될 수 있는 여부에 대해서 분석해 본다. 궁극적으로는 학생과 학부모 그리고 국가의 교육주체의 관계의 분석을 통해서 다변화하고 있는 교육환경, 이와는 상반된 경직된 공교육에서 학생의 교육기본권과 부모의 교육권의 실질적 실현을 위한 입법개선 방향에 대해서 논의한다.

영어초록

The era of digital transformation requires a shift away from the standardized and unified education achieved in existing public education to an education that fosters future core competencies (6Cs), so it is necessary to recognize the limitations of public education and fundamentally change it.
In order for humans to enjoy a free and humane life, it is an essential prerequisite to bring out one's own potential through education and develop and strengthen capabilities that suit the times. Considering the function of education, the problem of the limitations of the public education system, which cannot respond quickly to changes of the times, has been repeatedly pointed out. In particular, rather than human capabilities that can be applied to the standardized and unified systems required in industrial society, the capabilities required in the rapidly and diversely changing intelligent information society are individual, sporadic, and unconventional creative capabilities.
The social demand for individualized and diverse customized education is strengthening in order to cultivate talent with capabilities suitable for the intelligent information age. In this regard, in this paper, the problems and causes of the public education system's failure to proactively respond to the changes of the times are found in the structure of compulsory education implemented under the public education system and related legal norms are analyzed. After that, I will analyze whether the realization of the right to receive education under Article 31 of the current Constitution can be linked to the strengthening of the capacity of human resources required by our society now through education. Ultimately, through analysis of the relationship between students, parents, and National educational entities, I suggest the direction of legislative improvement for the practical realization of students' basic rights to education and parents' right to education in the diversifying educational environment and rigid public education that contradicts this.
