중국의 일대일로 전략과 무역분쟁해결제도 (China’s One Belt One Road Initiative and Resolution System of Trade Disputes)

초록

2013년에 시작된 시진핑 정부는 G2로서 미국에 대응하고 국내정세를 안정시키며 중진국의 함정에 빠지지 않기 위하여 새로운 경제발전 전략을 모색하였으며 현재까지 유럽 각국 뿐 아니라 한국과 일본 등 동아시아 국가들도 중국의 일대일로전략에 적극 동참하고 있다. 허나 일대일로 연선국가들은 다양한 법체계와 문화, 관습, 종교를 갖고 있으며 WTO에 가입하지 못한 국가들도 여럿 있다. 또한 경제발전 수준의 차이가 크고 국제관계나 국내정세가 불안정한 국가들도 포함된다. 이러한 국가들 사이의 교역이 활성화되면 그 분쟁의 성격이나 복잡성 및 해결방법이 현재와는 달라야 할 것이다. 본고는 국제무역분쟁의 해결방법에 초점을 두고 일대일로라는 특수한 배경하에서 상사분쟁을 어떻게 해결할 것인지를 고민하고자 한다.

영어초록

In 2013 Chinese President Xi Jinping put forward the concept of One Belt One Road, since then there have been frequent commercial conflicts in the countries and regions along the line due to commercial trade, and it is urgent to prevent the relevant issues. The paper focuses on the characteristics of the trade disputes under the “Belt and Road” initiative mainly on dispute resolution methods.
The “Belt and Road” runs through discursive Eurasia, with many countries and regions along the line. So it covers diversified economic culture, religious beliefs, laws and regulations, and commercial activities in different countries. Under such a complicated international background, it is difficult to deal with the diversified needs by using a single dispute resolution method such as traditional litigation, international arbitration or international mediation.
In order to solve this problem, it is necessary to establish a "Belt and Road" diversified dispute resolution system, which the Chinese government has already provided some suggestions for this. In 2018, the Chinese government announced its opinion on the establishment of a "Belt and Road" international commercial dispute resolution organization, pointing out the limitations of the current dispute resolution system, and ordering a combination of litigation, arbitration and mediation.
Depending on the characteristics of the "Belt and Road" dispute and the government's policy direction, this paper expects that the combination of arbitration and mediation will be used in the future, and suggests that Korean parties and scholars understand the combination system.
