『코리올레이너스』로 성찰하는 법률가의 소명 (The Vocation of the Lawyer in Shakespeare’s Coriolanus)

초록

법학전문대학원 제도의 도입을 통해 법학교육에 큰 전기가 마련된 후로 매년 많은 법률가들이 사회로 진출하고 있다. 그러나 법학교육의 현장에서는 기초법학 교육의 위기를 염려하는 목소리가 여전하다. 전문직으로서 새출발하는 법률가들이 사회에서 직업적 소명을 다함으로써 사회발전과 변화에 큰 힘이 되어야 함은 마땅한 일이다. 하지만 법률시장을 둘러싼 여러 변화 양상들이 법률가들의 건전한 소명의식 형성을 위협하는 현상도 더러 볼 수 있다. 예비법률가들은 법학전문대학원을 마치기까지 긴 교육과정을 통해 법률가로서 합당한 인격과 태도를 형성할 수 있도록 주도적으로 준비해야 하며, 여기에 법학교육을 맡은 기관과 교수들도 큰 책임을 지고 있음은 물론이다. 그러나 ‘법심(法心)’의 함양에 관한 한 누구도 자신하기 어려운 것이 현실이 아닌가 염려된다.
본 연구는 셰익스피어의 『코리올레이너스』를 통해 법률가의 소명이 무엇이며 어떻게 마련될 수 있는지 성찰해보려는 시도이다. 미국의 정치철학자 앨런 블룸(Allan Bloom)은 미국의 대학생들이 셰익스피어의 작품들을 통해 정치에 관해 깊이 이해하게 되기를 희망했는데, 그 이유는 셰익스피어의 작품 속에는 통치의 문제가 잘 묘사되어 있어 내면의 가치와 태도를 형성하기를 원하는 젊은 영혼들이 큰 도움을 받을 수 있기 때문이라 했다. 그는 통치의 문제를 다루는 비법을 알고 실천한 시저를 높이 평가한 반면, 코리올레이너스는 실패한 정치가로 비난했다. 본 연구에서는 코리올레이너스의 성공과 몰락에 관해 블룸이 내린 평가를 재검토했다. 흔히 법률가로서의 성공을 세속적 성공, 특히 정치적 성공과 동일시하는 경우를 더러 보게 된다. 블룸은 고대 로마 시대나 셰익스피어 시대나 현재나 본질적으로 동일한 것이 정치의 우선성(우월성)이라 지적했다. 우리 사회에서 정치적 성공도 추구하려는 법률가가 있다면 블룸의 견해를 공유할 것이라 여겨지므로 이에 관해 재검토했다. 자유주의는 자유를 맹목적으로 추구하는 관념이 아니다. 자유주의는 사회를 구성하는 여러 영역들이 있으며, 상호간에 독자적이고 자율적으로 기능함으로써 사회가 발전한다는 믿음을 가지고 있다. 우리는 법을 지배와 통치를 위한 수단으로 믿고 법의 영역을 다른 사회 영역들에 우선시했던 통치자들도 보았다. 법률가들이 과거의 경험에서 배운 것은 법이 시민의 자유를 보장하는 수단이지 통치의 수단이 아니라는 것이다. 사회를 지배하는 수단으로 법을 이용하려는 통치자에게 이용당하지 않으려는 자유주의적 법률가라면 법이 다른 사회 영역에 우선하지 않는 것처럼 정치가 모든 사회 영역에 우선하거나 우월하다는 믿음을 공유하지 않는다. 이러한 믿음과 태도를 가진 법률가는 사회 각 영역을 존중하는 겸손함을 겸비한다. 사회에 일생을 통해 헌신하고자 하는 법률가의 소명은 이런 겸손으로부터 준비될 수 있다.

영어초록

Since the establishment of the law school system in 2008 in Korea, legal education has made a contribution to training new lawyers and public-service jobs. However, the huge number of young lawyers graduating from law schools has failed to stop concerns regarding the crisis of foundational education that they are required to learn so as to fulfill their professional calling of serving the public interest. Recently, it is noticeable that the legal industry may threaten the vocation of a lawyer. Thus, law schools should urge would-be lawyers to shape a good personality and attitude through a long curriculum that helps complete legal education. Moreover, both legal institutes and professors should take great responsibility of tackling current problems and developing innovative curriculum.
This article aims to reflect on the vocation of a lawyer and how to shape it by reading William Shakespeare’s Coriolanus. Allan Bloom, one of the most famous political philosophers, once believed that Shakespeare’s works inspire American college students to better understand politics because his plays represent tyrants and good rulers. According to Bloom, furthermore, Shakespeare’s plays serve to nurture virtues and the legal mind for students. While Bloom praises Caesar for knowing and practicing ways of dealing with ordinary people, he accuses Coriolanus as a failed politician. In this precise context, we propose re-examining Bloom’s assessment of the extent of success and downfall that Coriolanus demonstrates not only as a warrior hero but also as a politician.
It is often the case that success as a lawyer is equivalent to worldly success, in particular, political success. Bloom points out that the priority of politics is the essence in every society including ancient Rome, Shakespeare’s, and our own. It is highly likely that a lawyer who seeks political success shares Bloom’s view. In order to prevent the lawyer’s calling from degenerating, we suggest training young lawyers with the ideas of liberalism through Shakespeare’s plays. Liberalism is not an idea of blindly pursuing freedom but a belief that society develops only insofar as sectors that make up society function independently and autonomously. We have seen rulers who utilized law as a means of domination and consequently prioritized the realm of law to other areas. What lawyers have learned from past experiences is that law is a means of ensuring civil liberties, not a means of domination. Libertarian lawyers who do not want to be directed by political rulers do not agree that politics takes precedence or superiority over other areas, just as laws do not take precedence over other areas. Lawyers with these beliefs are necessarily humble and show respect to all the other areas of society. It is from this modesty that a lawyer’s commitment to devoting his or her life to society can be prepared.
