중국 정부행위의 제도화: 인치에서 법치로 (The Institutionalization of Chinese Government Action: From rule of man to rule of law)

초록

본 연구는 중국정부의 행위준거가 종전 인치에서 법치로 전환되어 가는 과정을 제도화라는 이론적 논의를 통해 설명하고, 중국정부의 법치화 과정의 함의와 우리나라 정부의 행위준거에 대한 시사점을 제기하려는 목적을 가진다. 중국 정부행위의 비제도화 단계는 인치의 형성, 맥락, 제약, 지속성을 통해서, 그리고 제도화 초기･준비･과정 단계는 법치의 동인, 과정, 제약, 개혁이란 관점에서 설명한다. 중국 정부행위의 제도화의 특징을 보면, 첫째, 인치는 여전히 일정한 효용성을 가지고 생명력을 유지하고 있으며, 둘째, 현재 중국정부가 추구하는 법치화는 제도화의 초기･준비･과정 단계에 중첩되어 있으며, 셋째, 일상적 혹은 완전 제도화는 여전히 요원하며 중국정부가 궁극적으로 이루려는 미래의 지향점이라 할 수 있다.
연구의 함의로는 첫째, 중국정부가 추구하는 법치화는 사회주의시장경제의 신속한 발전을 촉진하기 위한 것이며, 둘째, 행정개혁을 촉진시키고 행정체제를 규범화･체계화하는데 기여하며, 셋째, 중국 인민의 사회생활의 보호 및 안정을 구현하며, 넷째, 국제 수준의 제도적 동형화를 통한 중국정부의 운영 및 관리의 규범화를 촉진하는 계기가 될 것이다. 시사점으로는 산업화와 민주화 과정에 이어서 저출산･고령화 사회 및 다문화 사회로 진입하는 새로운 행정환경에서, 우리 정부는 종전 경험하지 못한 다양하고 복잡한 행정수요를 해결하고 충족시켜야 할 책무를 맡고 있다. 이런 맥락에서 정부 운영과 관리의 준거로서 합리적 법치를 중심으로 정부행위를 추구하되, 개별･구체적 상황에 따라서는 절제된 인치가 보유한 순기능을 법치에 가미하는 운영의 묘가 필요함을 제기한다.

영어초록

This paper explains the action criteria of the Chinese government in the change from the rule of man to rule of law through the institutionalization theory, to induce the implications from the process of rule of law in the Chinese government and suggest the action criteria for the Korean Government. It will explain the non-institutionalization of Chinese government action by the formation, context, constraint, and continuance in rule of man. In addition, it will also explain the incipience, preparation, and process of institutionalization by the drive, process, constraint, and reform in the rule of law. The institutionalization characteristics of the actions of the Chinese government are as follows: first, the rule of man keeps usefulness and significance alive. Second, the recent process of rule of law in the Chinese government belongs to the incipience, preparation, and process by complexity. Third, the fully institutionalization is still distant and it may be the future orientation to catch up with by the Chinese government ultimately. The implications of this study are as follows: first, the pursuit of rule of law in the Chinese government is to step up the development of a socialist economy. Second, it will accelerate the public administration reform and pave the way for systematizing public administration. Third, it will protect the social life of the Chinese people and maintain stability. Fourth, it will upgrade the management and operation of the Chinese government by institutional isomorphism at the global level. The suggestions of this study are that as the transition happens from industrialization to democratization, and a Korean society that is facing a low birth-rate and aging society, the Korean government should solve new public administration needs by changing public administration. In this context, though the Korean government should use the criteria by rule of law, it can use the criteria of action through the mix between the rational rule of law and the temperate rule of man in specific situations.
