초록

학생의 권리를 보호하기 위해서는 학생이 학교에 재학하는 기간 중 공법상의 제약이 따르는 경우가 있다고 하더라도 일방당사자가 우월한 지위에 선다거나 특별히 사법관계와 구분하여 파악할 필요는 없다고 본다. 따라서 사립학교는 물론이고 국가나 지방자치단체와 학생 측의 법률관계도 계약의 관점에서 분석되어야 할 것이다. 재학계약은 계약당사자인 학생 측과 학교 측이 권리의 발생과 변동에 관하여 합의를 함으로써 법적구속력을 발생시키는 행위라고 할 수 있다.
따라서 본고에서는 재학 계약관계에서 재학계약의 당사자, 재학계약의 성립과 종료, 재학계약의 성질, 재학계약의 내용 등을 중심으로 구체적인 법률관계를 논의하였다. 결국 학생의 재학관계는 학교 측과 학생 측의 권리의무관계로서, 사적자치의 원리가 적용되며, 이를 통하여 학생의 권리가 보장되고 사법적 구제가 가능한 사법상의 재학계약이라고 보는 것이 더 합리적이라고 보았다.
