유럽인권재판소의 개인청구 수리기준에 관한 연구 - 유럽인권재판소의 결정례를 중심으로 - (A Study on the Standard of Entertaining an Individual Claim in the European Court of Human Rights -Focusing on the Decisions in the European Court of Human Rights-)

초록

유럽인권재판소는 개인이 제기한 소송을 심리하는 절차를 통하여 인권을 보장하기 때문에 유럽인권조약을 인권의 국제적 보장에 대하여 가장 완성된 모델로평가받고 있다. 또한 유럽인권재판소는 유럽인권협약의 체약국이 증가하면서 지역적 인권보장 시스템의 유지와 발전에 중요한 역할을 하고 있다. 그 이유는 개인적사안에 대한 청구를 직접적으로 수리하고 심리하는 유럽인권재판소만의 특수한인권보장 시스템이기 때문이다. 이러한 인권보장 시스템이 제14의정서가 발효되면서 변화가 일어나고 있다. 기존의 개인청구수리 기준으로는 유럽인권재판소의 재판업무의 증가와 비효율성, 그리고 체약국 자체적인 인권보장 기능의 약화 등이문제로 제기되고 있다. 이러한 문제를 해결하기 위하여 제14의정서의 발효와 동시에 유럽인권협약 제35조 제3항에 ‘상당한 불이익(significant disadvantage)’이라는개인청구수리 기준을 삽입하였다. 유럽인권재판소는 이러한 개인적 청구 수리기준이 생성되면서, 사안의 중대성과 유럽인권협약에서 보장하고자 하는 인권을 보장하기 위한 구체적인 노력과 재판업무의 효율성을 증대하고 있다. 본 논문에서는개인적 청구의 수리기준인 상당한 불이익의 개념과 적용을 유럽인권재판소의 결정례를 통하여 검토하고자 한다.

영어초록

The European Court of Human Rights guarantees human rights through the procedure of trying a case that was raised by an individual. Thus, the European Convention on Human Rights is being evaluated as the most complete model on the international human rights guarantee. Also, the European Court of Human Rights is playing an important role in maintaining and developing the local human rights guarantee system according to a rise in treaty powers of the European Convention on Human Rights. The reason is because it is the human rights guarantee system peculiar to the European Court of Human Rights, which directly entertains and tries a claim for an individual issue. This human rights guarantee system is being happened a change according to the effectuation of the protocol No. 14. As for the existing standard of entertaining an individual claim, the problems are being brought up such as an increase and inefficiency in the trial work of the European Court of Human Rights, and the weakening in its human rights guarantee function of the treaty power. To solve these problems, the standard of entertaining an individual claim dubbed ‘significant disadvantage’ was inserted into Article 35, Clause 3 of the European Convention on Human Rights, simultaneously with the effectuation of the protocol No. 14. The European Court of Human Rights is increasing a specific effort and the efficiency of the court proceedings in order to guarantee human rights, which the European Convention on Human Rights aims to secure, along with the seriousness of an issue, as the standard of entertaining an individual clam is generated in this way. The purpose of this study is to examine a concept and application of significant disadvantage, which is the standard of entertaining an individual claim, through the decisions of the European Court of Human Rights.
