불법촬영물 유포사례와 피해자 지원방안에 관한 연구 (A Study on the Cases of Illegal Photograph and Video Distribution and Victim Assistance Plans Criminal Psychology)

초록

2020년 텔레그램 ‘n번방 사건’을 계기로 불법 촬영물 및 성 착취물 유포행위에 대하여 사회적 관심과 시선이 늘어났다. 이에 따라 각종 법안 및 정책이 쏟아졌고 불법촬영물의 유포와 성착취가 우리사회에 미치는 악영향에 대하여 공론화 하기도 했다. 그러나 아직도 일부 소셜미디어와 웹하드 등 플랫폼 안에서는 여전히 불법촬영물이 유포되고 있으며, 많은 피해자들이 자신의 영상이 유포되거나 유통될 수 있다는 두려움은 여전하다. 디지털 성폭력은 카메라 등과 같이 디지털 기기를 이용하여 신체를 촬영하거나 유포, 유포협박, 저장, 판매 등 정보통신 기술을 매개로 온라인 공간에서 나타나는 성폭력이다. 그러나 온라인 상에 나타나는 디지털 성폭력의 경우 성폭력이라는 인식보다는 하나의 가쉽거리로 보여지는 경향이 크며, 비동의 촬영물 외에도 동의해서 촬영한 영상이 외부에 유포될 때에는 아직도 피해자보다는 가해자 중심의 개념 정립이 확연하게 나타나고 있는 실정이다. 불법촬영물 범죄의 경우 이미지의 합성이나 유포 등이 용이하여 그 소비의 가능성은 매우 높은편이며, 개인 간에 촬영된 영상이 불법사이트로 유입되거나 성매매 광고에 활용되는 경향이 나타난다. 불법촬영을 통한 범죄의 유형으로는 촬영물을 유포하거나 재유포하는 행위가 있으며, 이외에도 온라인 그루밍 같은 온라인 성착취, 사진합성 등의 딥페이크 범죄, 상대방의 벗은 몸 등을 영상으로 촬영하여 협박하는 몸캠피싱 등이 있다. 이러한 범죄들은 인격을 침해하는 폭력이며, 촬영 및 유포에 대한 분노와 두려움, 공포 불안 등 심리적 피해를 입히게 되는 범죄이다. 그럼에도 불구하고 우리 사회는 아직까지 피해자 비난으로 인한 현상이 나타나고 있으며 단속과 처벌이 약하다는 지적을 받고 있다. 결국 불법촬영물에 대한 피해자적 관점에서의 지원을 위해서는 단순한 사이버 범죄의 피해자가 아닌 온라인상의 성폭력 피해지라는 인식하에 지원하여야 할 것이며, 이를 위해서는 디지털성범죄피해자지원센터가 컨트롤타워 역할을 하여 정확한 모니터링과 피해유포물 삭제방안을 지원하도록 할 필요가 있다. 또한 각 플랫폼별 불법촬영물에 대한 인식교육을 실시하고 삭제지원에 있어 능동적으로 참여할 수 있는 분위기를 조성할 필요가 있다. 뿐만 아니라 수사기관과의 연계를 지원하고 채증 등 증거수집을 지원하며, 성폭력피해자 지원정책을 온라인 성폭력 피해자에게도 적용할 수 있도록 그 지원 체계를 활성화 하여야 할 것이다.

영어초록

The Telegram Room No. N Case in 2020 has increased social attention to the behaviors of distributing illegal photographs and videos and sexual exploitation contents. As a result, a plenty of legislations and policies have been made and the evil effects of illegal photograph and video distribution and sexual exploitation on the society have been turned into a public issue. Still, illegal photographs and videos are being distributed in some social media and platforms, including Webhard, and a lot of victims still fear the possibility of their videos being distributed or spreading. Digital sexual violence refers to a type of online sexual violence mediated by information and communication technologies, which involve filming the body and distributing or threatening to distribute, storing, and selling the contents by using digital devices, such as cameras. However, digital sexual violence online is more likely to be regarded as a gossip than as sexual violence; when videos made with consent are distributed outside, conceptualization is still clearly based on the offender rather than on the victim. Easy composition or distribution of images in those crimes involving illegal photographs and videos makes it very likely to distribute them and personally filmed videos tend to be put into illegal sites or used for prostitution advertising. The types of crime using illegal filming include behaviors of distributing or redistributing the contents, online sexual exploitation, such as online grooming, Deep Fake crimes, such as photograph composition, and body-cam fishing, which involves filming someone's naked body and blackmail. These crimes are violence against personality and cause psychological damages, including anger, fear, terror, and anxiety about filming and distribution. Still, victims are blamed for such crimes, which are poorly controlled and punished, in the South Korean society. To give assistance from the viewpoint of illegal filming victims, it is necessary to have an idea that they are not simply victims of cyber-crimes but online sexual violence victims and the Digital Sexual Violence Victim Assistance Center needs to serve as a control tower to monitor them correctly and support the plans for deleting the relevant contents. It is also necessary to give training aimed at giving a better understanding of illegal photographs and videos for each platform and create a climate for active participation in the efforts to delete them. Additional efforts should be made to support the association with investigation agencies and evidence collection and activate the assistance system with the objective of making sexual violence victim assistance policies applicable to online sexual violence victims.
