군인 인권침해에 관한 국가인권위원회 결정례 분석-병사를 대상으로 한 최근 결정례를 중심으로- (An Analysis of the Judgments by the National Human Rights Commission of Korea on the Violations of the Rights of Soldiers - Centered on Cases Related to Soldiers out of the Judgments Issued in Recentl)

초록

본 연구의 목적은 군 조직 내에서 병사에게 발생한 인권침해가 무엇인지 살펴보고 병사의 인권을보장하기 위한 방안을 제시하고자 했다. 이를 위해 2019년도에 발행된 국가인권위원회 결정례를 연구 대상으로 삼아 국가인권위원회에 진정된 인권 침해 사건 5개를 분석하였다.연구 결과, 병사에게 나타난 인권 침해 내용은 과도한 정기 외출⋅외박 제한으로 행복추구권 중 휴식권 침해, 욕설 등을 통해 인격권 침해, 총상에 따른 적절한 의료조치 미비 및 유치장 감금 그리고안전권 미확보로 신체의 자유 침해, 병사 개인의 의사에 반한 징계 혐의 사실 및 징계 처분을 고지하여 개인정보 및 사생활 자유 침해 이상 다섯 가지로 나타났다. 이러한 인권 침해행위 가해자는 모두지휘관 등의 간부에 의해서 벌어졌다.병사의 인권을 보장하기 위해서는 병사들의 인권감수성을 길러주어 자신의 인권을 스스로 주장할 수있도록 해야 한다. 그리고 병사들을 지휘하는 지휘관 등 간부들의 인권감수성을 향상시키고 인권 친화적군 조직을 조성할 필요가 있다. 또한 인권 침해가 발생하면 즉시 군 내부 구제제도와 군 외부 구제제도가 효과적으로 작동되도록 기능을 강화할 필요가 있다. 군 내부적 구제제도를 통해 실질적인 인권보장이되기 위해서는 내부 구제제도를 독립기구화 하여 군 조직의 영향을 받지 않도록 할 필요가 있으며, 외부의 국가인권위원회는 실효성 없는 권고에서 법적인 효력을 지닌 권한으로 전환시킬 필요가 있다. 나아가군 관련 시민단체 등과 협력하여 군 인권 보호를 위한 감시체계가 전방위로 작동되도록 할 필요가 있다.

영어초록

The purpose of this study is to investigate the violations of soldiers’ human rights within the Korean military and to provide suggestions to secure the human rights of the soldiers. To do so, the study analyzed five cases of human rights violations that were filed with the National Human Rights Commission of Korea, out of the judgments issued by the National Human Rights Commission of Korea in 2019. The study revealed five types of soldiers’ human rights: the violation of the right to rest as an aspect of the right to pursue happiness, by excessively limiting outings and sleeping out; violation of personal rights through cursing and abusive language; violation of the rights of personal freedom due to inadequate medical treatment for gunshot wounds, locking the soldiers in detention rooms, and not protecting safety rights; and violation of personal information and privacy by publicly posting disciplinary charges and disciplinary actions without the consent of the soldiers. The perpetrators of the human rights violations were all commissioned officers such as commanders. To secure the human rights of the soldiers, it is necessary to develop the human rights sensitivity of the soldiers so that they can claim their own human rights. In addition, it is necessary to develop the human rights sensitivity of commissioned officers such as commanders who direct the soldiers, so that the military will be more human rights-friendly. Furthermore, the relief systems within and outside the military should be reinforced so that the systems will be effective in cases of human rights violation. To secure actual human rights with the relief systems within the army, the system should be independent from the military so that it will be outside the control of the military, and the National Human Rights Commission of Korea should change the current recommendations that have no actual effects on jurisdictions with legal effects. Moreover, there should be omnidirectional surveillance systems to protect the human rights of the soldiers in cooperation with military-related non-governmental organizations.
