테러방지법상 테러대비 및 대응체계 발전방안에 관한 연구 : 재난 및 안전관리 기본법 및 시행령 비교를 중심으로 (Studies on the development of Preparation and response system for terrorism under the Counter-Terrorism Law : Focusing on the Disaster and Safety Management Basic Law and the Comparison of Enforcement)

초록

「국민보호와 공공안전을 위한 테러방지법」및 동 시행령에 명시되어 있는 테러피해의 유형과「재난 및 안전관리 기본법」및 동 시행령에 명시되어 있는 재난피해의 유형은 입법목적 및 법적 성격과는 전혀 다르다. 다만 테러방지법상 명시되어 있는 “테러”의 형태와 재난안전기본법상 명시되어 있는 “사회재난”의 형태는 어느 정도 합치되는 부분을 발견할 수 있다. 이에 따라 본 글은 테러방지법상 테러대응체계가 재난안전기본법상에 명시되어 있는 재난의 대비, 대응체계와 비교하여 미흡한 부분은 없는지 또는 보완해야 할 부분은 무엇인지 살펴볼 필요가 있다.
그동안 테러방지법상의 문제점으로 제기되고 있는 문제들, 예를 들어 입법과정에서의 진통과 직권상정의 문제, 인권침해에 관한 규정, 테러방지법상 각종 용어의 정의에 대한 불명확성, 국가정보원의 권한 집중에 대한 문제, 군 병력 동원에 대한 위헌성, 인권보호관 활동의 한계 등에 대해 테러방지법 제정 이후 지속적으로 제기되어 왔다. 그러나 최근 테러의 유형을 살펴보면 재난안전기본법상 명시되어 있는 사회재난 유형 중 화생방사고로 인한 국가핵심기반의 마비, 감염병 확산으로 인한 피해 등의 형태를 가장한 테러의 가능성도 충분히 있어 이에 대한 대비 및 대응체계는 우리나라의 테러방지법상 규정된 내용으로는 한계가 있다.
따라서 본 연구에서는 테러방지법상의 테러대비 및 대응에 대해 재난 및 안전관리 기본법과 비교하여 테러발생에 대비한 각 부처별 준비사항과 테러발생 시 원활한 테러대응체계가 구축될 수 있도록 대안을 제시하고자 한다. 그동안 테러방지법상의 문제점들을 검토하면서 주로 테러 및 테러단체의 정의, 테러의 예방활동과 처벌에 중점적으로 연구가 되어 있다. 하지만 현실적으로 테러가 발생한다면 초동대응 및 피해확산방지, 그리고 안전을 최대한 확보하도록 해야 하는데 대응을 잘하지 못해 추가적인 인명·재산상의 피해가 발생하여 확대된다면 이에 대한 대응체계 마련이 시급할 것으로 판단된다. 그리고 이러한 테러가 발생한다면 이에 대한 대비 또한 중요한 문제로 부각될 것이다. 그러므로 테러발생에 대비한 대비계획 정례화를 통해 사전대비를 철저히 하고 테러발생 시 대응활동기준을 좀 더 명확히 함으로써 재난 및 안전관리 기본법상의 대응규정 비교를 통해 상황에 맞게 준용할 수 있다면 테러발생 시 현장의 혼란을 잠재우고 국민의 생명과 재산에 대한 피해를 최소화하며 국가 및 공공의 안전을 확보하는 테러방지법의 목적을 추구할 수 있을 것이다.

영어초록

The types of terrorism damage specified in the Act on Prevention of Terrorism for the Protection of the People and Public Safety and its Enforcement Decree and the types of disaster damage specified in the 「Disaster and Safety Management Basic Law」 and its Enforcement Decree are completely different from the legislative purpose and legal nature. However, there is some overlap between the type of “terrorism” specified in the Counter- errorism Law and the type of “social disaster” specified in the Disaster and Safety Management Basic Law. Accordingly, this article needs to examine whether the terrorism response system under the Counter-Terrorism Law is lacking or what needs to be supplemented compared to the disaster preparedness and response system specified in the Disaster Safety Management Basic Law.
Issues that have been raised as problems in the Counter-Terrorism Law, such as the pain and ex officio problem in the legislative process, regulations on human rights violations, the uncertainty of definitions of various terms in the Counter-Terrorism Law, and the concentration of authority of the National Intelligence Service Since the enactment of the Counter-Terrorism law, issues such as the unconstitutionality of the mobilization of military forces and the limitations of human rights protection officers have been continuously raised. However, looking at the types of recent terrorism, among the types of social disasters specified in the Disaster Safety and Security Management Basic Law, there is a sufficient possibility of terrorism disguised as paralysis of the national core infrastructure due to chemical, biological and radiological accidents and damage caused by the spread of infectious diseases, so prepare for and respond to them The system has limitations in terms of the content stipulated in the Counter-Terrorism Law of Korea.
Therefore, this study compares the preparedness and response to terrorism under the Prevention of Terrorism Act with the Disaster and Safety Management Basic Law, and proposes an alternative plan to establish a smooth terrorism response system in case of terrorism and preparations for each department in preparation for terrorism. In the meantime, while examining the problems of the Counter-Terrorism Law, research is mainly focused on the definition of terrorism and terrorist groups, and the prevention activities and punishment of terrorism. However, in reality, if a terrorism occurs, the initial response, prevention of damage spread, and safety must be secured as much as possible. And if such a terrorism occurs, preparation for it will also emerge as an important issue. Therefore, if it is possible to thoroughly prepare in advance through the regularization of preparedness plans in preparation for terrorism occurrences and clarify the response activity standards in case of terrorism occurrences and apply them appropriately to the situation through comparison of the response regulations in the Disaster and Safety Management Basic Law, It will be possible to pursue the purpose of the Counter-Terrorism Law, which is to calm confusion, minimize damage to people's lives and property, and secure national and public safety.
