원자력동력원(NPS)의 국제법적 규제 (International Regulation of Nuclear Power Sources)

초록

원자력동력원(Nuclear Power Sources)은 특수한 우주임무를 위하여 필수적인 기술이다. NPS는 방사성동위원소발전기(radioisotope generators) 유형과 핵분열원자로(fission reactors) 유형의 두 가지 형태로 발전되어 왔고 각각 독자적인 특성을 가져 여러 우주임무에 사용되어 왔다.
NPS는 핵물질을 사용하기 때문에 핵물질과 이것이 생산하는 원자력이 갖는 인명과 환경에 미칠 수 있는 잠재적 위험을 안고 있고 우주임무를 위한 NPS 이용 시 안전문제가 규제되어야 한다. 국제사회는 우주조약을 비롯한 기존 우주규범의 보완하기 위하여 1992년 UN의 NPS원칙선언, 2009년 UNCOPUOS와 IAEA의 공동 작업으로 NPS안전체제라는 구속력은 없지만 NPS의 설계, 제작, 운용 등에 있어서의 안전기준과 안전평가 등에 대한 기본 원칙과 규제내용을 담은 문서를 채택하였다. 또한 핵사고시 조기통보에 관한 협약, 핵긴급상황에서의 지원에 관한 협약 등 일부 국제원자력규범이 NPS의 안전규제와 긴급 상황에의 대응을 위한 기본 규범의 역할을 감당하여 왔다. 한편 환경손해를 야기하지 않을 책임, 사전주의원칙, 환경영향평가, 통지, 협의 및 지원에 관한 절차적 협력 원칙 등 국제환경법 상의 일반원칙도 NPS의 안전이용을 위하여 적용될 수 있는 규범이다. 하지만 국제적 규제는 적용 규범의 구체성 결여, 중요 문서의 구속력 결여, 적용범위의 제한 등과 같은 문제점을 안고 있어 이를 해결하기 위하여 장기적으로 NPS에 특화된 구속력 있는 조약을 체결할 필요가 있고, 단기적으로는 국제규제기준을 반영한 국내법 또는 연구기관의 내부규칙에 의한 효율적 규제방안이 모색되어야 한다.
우리나라는 기후와 기상변화를 탐지하기 위한 거대 위성의 발사, 달과 그 자원의 탐사 및 개발 및 소행성 우주자원의 탐사와 개발과 같은 우주개발목표를 가지고 있다. 이들 목표를 달성하기 위해서는 소형위성 개발과 함께 NPS기술의 개발과 발전이 가까운 장래에 이루어져야 한다. 이는 NPS의 안전규제라는 법적 과제도 안게 된다는 것을 의미한다. 과학계와 법률분야가 긴밀한 소통과 협력 속에서 기술 기반과 미국의 NPS에 관한 대통령 행정명령이나 ESA의 NPS내부규칙과 같은 규제기반을 마련해야 할 것이다.

영어초록

Nuclear Power Sources(NPS) is an essential technology for special space missions. NPS has been developed in two forms: the radioisotope generator type and the fission reactor type, and each has its own characteristics and has been used for various space missions. NPS space missions has potential risks to human health and the environment due to the nuclear materials, safety and environmental issues arising from NPS should be regulated carefully to the full. International community adopted documents such as the 1992 United Nations Principles on NPS and 2009 NPS Safety Framework which was drafted and adopted by the UNCOPUOS and the IAEA jointly. A couple of international nuclear treaties such as the Convention on Early Notification of a Nuclear Accident and the Convention on the Assistance in the Case of a Nuclear Accident or Radiological Emergency. Additionally, general principles of international environmental law such as responsibilities not cause environmental damage, precautionary principles, environmental impact assessment, and procedural cooperative principles such as notification, consultation and assistance can be also applied for the safety regulation of NPS. However, international regulations has problems such as lack of specific application norms, no binding force of critical international documents and limitations of coverage and application scope, etc., so it is necessary to conclude a binding treaty which focuses to the NPS regulation in the long run, and efficient regulatory measures by domestic laws or internal rules of research institutions that reflect international regulatory standards should be sought in the short run.
Korea has space development targets such as the launch of giant satellites to detect climate and weather changes, exploration and development of the moon and its resources, and exploration and development of asteroid resources. It is necessary to develop NPS technology and small satellites to achieve these goals in the near future. This means that there will also be a legal challenge of NPS safety regulations. Scientific community and legal expert have to communicate and cooperate for preparing regulatory foundations such as the Unites States Presidential Executive Order on NPS and the ESA's internal rules.
