통시적 자유보장과 사법적 파상력 (Intertemporal Freedom Guarantee and Judicial Pa-sang-ryok)

초록

독일연방헌법재판소는 이산화탄소 감축기준을 정한 연방기후보호법 조항에 대한 헌법소원 사건에서 독일기본법 제20a조가 입법부에 대한 구속력을 가지는 재판규범임을 확인하면서 위 조항의 해석을 통해 통시적 자유보장(Intertemporale Freiheitssicherung)이라는 기본권의 내재적 성격을 규명하고, 심판대상조항이 미래의 일반적 자유에 대하여 침해유사적 사전효과를 미치기 때문에 기본권제한입법과 유사한 헌법적 정당화가 필요함에도 시대와 세대를 넘어 이산화탄소 감축부담을 균형 있게 분배하여야 할 비례성 요구를 충족하지 못하여 헌법에 합치되지 아니한다고 판시하였다.
이 글에서는 우리나라를 포함하여 세계적으로 기후재난이 현상을 넘어 일상이 되어가는 시대에, 국민의 보편적이고 평등한 기본권 보장을 존립근거이자 목표로 하는 법치국가와 그 (헌법)재판기관이 ‘지속가능한’ 기본권 보장에 관하여 깊이 성찰해야 한다는 전제에서 독일 헌재가 대상결정에서 제시한 ‘통시적 자유보장’에 관한 결정요지와 그 의미, 시사점에 대하여 살펴본다. 그리고 최근 선고된 우리나라 헌법재판소의 기후소송 결정과 독일 결정 설시의 관련된 부분을 비교하여 분석해 본다.
마지막으로 전 세계적 기후재난이라는 전대미문의 파국적 상황에 직면하여, 국민국가 발전과 번영의 상징이었던 인간중심적 탄소경제를 정당화하였을 뿐만 아니라 여전히 우리 헌재 기후소송 결정 및 사법실무 일반에 짙게 스며있는 자율적 이성에 기초한 ‘인간중심적 인간 존엄과 자유권적 기본권’ 중심의 법패러다임(선이해)이 가진 ‘위상적 특권’에 대한 성찰과 반성이 필요하고, 이를 통해 거대한 법이론적 전환으로 나아가야 한다고 주장한다.

영어초록

In a constitutional complaint case regarding a provision of the Federal Climate Protection Act that sets carbon dioxide reduction standards, the German Federal Constitutional Court confirmed that Article 20a of the German Basic Law is a legal norm that has binding force on the legislature, and through the interpretation of the above provision, clarified the inherent nature of the fundamental right called “intertemporale Freiheitssicherung” and ruled that the provision in question has a prior effect similar to an infringement on future general freedom, and therefore requires a constitutional justification similar to legislation restricting fundamental rights, but does not meet the requirement of proportionality to evenly distribute the burden of carbon dioxide reduction across eras and generations, and therefore is unconstitutional.
In this article, in an era where climate disasters are becoming a daily occurrence, not just a phenomenon, but a global phenomenon, including in Korea, the rule of law state and its (constitutional) judicial institutions, whose raison d’etre and goal is to guarantee universal and equal basic rights for the people, must deeply reflect on the guarantee of ‘sustainable’ basic rights. Based on this premise, we will examine the gist of the decision on ‘intertemporal freedom guarantee’ presented by the German Constitutional Court in its subject decision, its meaning, and implications. In addition, we will compare and analyze the relevant parts of the recent climate lawsuit decision of the Constitutional Court of Korea and the German decision.
Finally, in the face of the unprecedented catastrophic situation of the global climate disaster, it is argued that we need to reflect on and introspect the ‘topological privilege’ of the legal paradigm (pre-understanding) centered on ‘human dignity and liberal fundamental rights based on autonomous reason’ that not only justified the human-centered carbon economy that was the symbol of the development and prosperity of the nation-state, but is still deeply embedded in our Constitutional Court’s climate litigation decisions and judicial practice in general, and that we should move forward with a great legal theoretical transformation through this.
