기업특성이 순응/비순응 조세회피전략 선택에 미치는 영향 (The Effect of Firm Characteristics on Conforming and Nonconforming Tax Avoidance)

초록

이익상향을 전제하는 전통적 세무회계 연구에서 조세회피는 대부분 보고이익과 과세소득의 차이 또는 비율을 통해 측정되고 있고, 과세소득을 낮추기 위해 보고이익을 감소시키는 조세회피(이하 “순응 조세회피”)의 개념은 배제되고 있다. 본 연구는 순응/비순응 조세회피의 이원화된 관점에서, 자본시장압력, 기업지배구조, 성장성 등의 기업특성이 세무전략에 미치는 영향을 분석한다. 조세회피를 추구하는 데 있어, 자본시장압력은 보고이익 상향을 유발하고, 기업지배구조와 성장성의 요소는 이해관계자에 대한 정보의 투명성을 제고할 것으로 예상된다. 실증분석을 위한 표본은 2017년부터 2020년까지 한국거래소에 상장된 유가증권 상장기업과 코스닥 상장기업의 5,710개 기업－연도 자료를 사용하였으며, 실증분석 결과는 다음과 같다.
첫째, 자본시장압력의 크기를 단기차입금 비중, 신용등급 존재 여부, 배당성향 등으로 측정하였고, 자본시장압력은 순응 조세회피에 대해 음(－)의 관계를, 비순응 조세회피에 대해 양(＋)의 관계를 나타내었다. 자본시장압력 하의 경영자는 보고이익－과세소득의 차이에 따른 세무조사 위험, 정보비대칭, 평판훼손 등의 부작용을 감수하더라도 비순응 조세회피를 더 추구한다는 것을 의미한다. 둘째, 기업지배구조의 우수도는 순응 조세회피에 대해 양(＋)의 관계를, 비순응 조세회피에 대해서 음(－)의 관계를 나타냈다. 셋째, 기업의 성장성은 순응 조세회피에 대해 양(＋)의 관계를, 비순응 조세회피에 대해 음(－) 의 관계를 나타냈다.
본 연구는 국내 상장기업을 대상으로 최초로 순응 조세회피를 측정하여 이원적 조세회피 경향에 대해분석하였고, 순응/비순응 조세회피에 영향을 미치는 기업의 특성을 규명하였다. 본 연구의 결과는 조세회피에 대한 관점을 확장함으로써, 과세당국, 투자자 등과 같은 이해관계자가 경영자의 조세회피 전략을 효율적으로 감시하고 대응하도록 한다. 또한 국내 기업에 순응 조세회피 개념을 적용함으로써, 조세회피와 관련된 다양한 추가연구가 가능하도록 한다.

영어초록

Tax avoidance that reduces financial reported income to lessen taxable income cannot be determined through final reported income and taxable income, so this type of tax avoidance (hereinafter referred to as “Conforming Tax Avoidance”) has been excluded from traditional tax avoidance studies that assume managers to pursue elevated profits. This study aims to grasp the management’s tax strategy from a dual perspective, including the concept of conforming tax avoidance, and to analyze how the financial characteristics or business environment of a firm affects the management’s tax avoidance strategy.
The results of empirical analysis are as follows. First, the capital market pressure measured by the proportion of short－term borrowings, the existence of credit ratings, and dividend propensity is negatively associated with conforming tax avoidance and positive on nonconforming tax avoidance. Second, the level of corporate governance measured by foreign equity and outside director ratios engages with significantly more conforming tax avoidance and less nonconforming tax avoidance. Third, the growth rate of a firm engages with significantly more conforming tax avoidance and less nonconforming tax avoidance.
This study is differentiated from previous studies in the following points. First, tax avoidance trends are analyzed by measuring conforming tax avoidance for the first time for domestic listed companies in Korea. Second, unlike previous studies, variables related to the bond market and dividend propensity are used to objectively measure the capital market pressure. Third, the characteristics of companies that affect conforming and nonconforming tax avoidance are expanded to corporate governance, growth potential, owner management and family enterprise.
The results of this study allow corporate stakeholders such as tax authorities and investors to dualize their views on tax avoidance and efficiently monitor and respond to managers’ tax avoidance strategies from their respective perspectives. In addition, this study provides a new perspective on future tax avoidance－related research and provides the possibility of further research by applying the concept of conforming tax avoidance to domestic listed companies.
