헌법국가란 무엇인가 - 독일적 개념의 연원과 한국적 수용가능성 - (What is a Constitutional State (Verfassungsstaat) - Origin of the German Concept and Acceptability in Korea -)

초록

우리 헌법재판소는 헌정주의와 관련하여, ‘입헌주의’, ‘입헌민주국가’, ‘입헌민주헌법’, ‘입헌주의적 헌법’, ‘입헌적 민주주의’, ‘민주적인 헌법국가’, ‘반입헌주의’, ‘반법치주의’라는 표현을 사용한 바가 있다. 그러나 그 내용적 요소를 명시적으로 제시한 예는 아직 없는 것으로 파악된다. 한국의 헌법적 논증, 특히 ‘헌법재판소’에서의 설시에서 위와 같은 표현을 사용함에 있어서는 헌정주의에 대한 독일적 개념 전통인 ‘헌법국가’라는 개념을 참고하고 유의할 필요가 있겠다고 판단된다. 독일적 연원을 가지는 헌법국가 개념에 관한 논의는 영미적 전통의 헌정주의에 대한 논의보다 더 많은 점에서 ‘기술적’이라기보다는 ‘규범적인’ 면에 집중하고 있으며, 그것은 ‘있어야 할 것’에 관한 연역적, 도그마틱적 논의를 상대적으로 더 중요하게 여기고 있기 때문에, 규범적 논증을 주된 임무로 하는 헌법재판기관에서 활용하기 적합하기 때문이다. 독일 연방헌법재판소는 이러한 개념을 실제 주요 결정문들의 논증에서도 활용하여 왔다. 특히 이러한 헌법국가라는 개념은 ‘(자유)민주적 기본질서’와 밀접한 관계가 있으면서도 그를 포함한다고 볼 수 있는 개념이기 때문에, (자유)민주적 기본질서의 위배여부가 문제되는 정당해산, 탄핵 등의 사건에 있어서 하나의 ‘규범적 개념’이자 도구로서 사회에서의 헌법적 논쟁에서나, 헌법재판소 등 헌법기관에서의 유권해석적 논증에 사용되어야 할 필요성과 적실성이 높다고 할 수 있다. 다만 우리 헌법의 해석에 있어서는 유의할 점은, ‘사회국가원리’나 ‘연방주의’ 등 독일 기본법 제79조에 기반해서만 이해될 수 있는 ‘헌법국가’의 내용 요소는, 개정불가사항이 명문상 존재하지 않는 우리 헌법 해석상의 ‘헌법국가(헌정주의)’ 개념의 내용으로 바로 연결되기는 어렵다는 것이라고 하겠다.

영어초록

In its decisions, the Constitutional Court of Korea (hereinafter ‘CCK’) has used the following words with regard to constitutionalism: 'constitutionalism', 'constitutional democratic state', 'constitutional democratic constitution', 'constitutional constitution', 'constitutional democracy', 'democratic constitutional state', 'anti-constitutionalism' ‘anti-rule-of-law’ and so on. However, there has not been an example of explicitly presenting the content element yet. In using the above wordings in the constitutional discussions and arguments in Korea, especially in the CCK, it seems that it is necessary to refer to the concept of ‘Verfassungsstaat (constitutional state)’, the German concept tradition of constitutionalism. The discourses on the concept of the ‘Verfassungsstaat’ in Germany have focused more on 'normative' rather than 'prescriptive' in more respects than the discussion of constitutionalism in the Anglo-American tradition. In other words, they have based on deductive and dogmatic aspects. More importantly, the Federal Constitutional Court of Germany (hereinafter ‘FCCG’) itself has used this concept in the reasoning of a number of important decisions. Especially, the concept of the ‘Verfassungsstaat’ is closely related to the concept of the ‘freiheitliche demokratische Grundordnung’ (free and democratic basic-order) and the former includes the latter. Therefore, in the jurisdictions of CCK, especially dissolution of political party, impeachment, in which the violation of 'free democratic basic order' matters, there is the necessity and adequacy that the concept of Verfassungsstaat should be used as a common conceptual tool, in the constitutional discussion and debate in society or in arguments in constitutional institutions such as the CCK. However, in the interpretation of the Korean Constitution, it is important to note that one should not unquestioningly adopt all the content elements of the German concept. Because some content elements of the German concept can only be understood through the sentences of Article 79 of the German Basic Law, such as 'Social State (Sozialstaat)' and 'Federalism'.
