띠아오위따오/센카쿠렛토 분쟁의 쟁점과 독도에의 함의 (Dispute on the Territoriality over Diaoyudao/Senkaku Islands and Its Implication over Dokdo)

초록

띠아오위따오/센카쿠렛토(Diaoyudao/Senkaku Islands)는 대만의 북동쪽으로 약 170km, 중국 본토로부터 330km, 이시가키지마(石垣島)의 북쪽 170km, 오키나와(沖繩)의 서쪽 410km의 거리에 위치한 작은 섬들이다. 대략 대만과 일본 사이의 중간에 위치한 관계로부터 알 수 있듯이, 띠아오위따오는 중일 양국의 영유권이 애매하게 될 수 있는 소지가 농후했다. 더구나 인간의 항구적 거주가 적합하지 않기 때문에 실효적인 국가의 지배가 쉽지 않았고 또 과거의 중일 양국이나 류큐가 그렇게 할 필요도 없었다.
1971년 이후, 띠아오위따오를 둘러싼 영유권 분쟁은 세계적으로도 가장 치열하고 해결하기 힘든 도서 분쟁들 중의 하나로 평가되고 있다. 중국과 일본은 이러한 섬들에 대한 자국의 영유권이 국제법적으로나 역사적으로 분명하다고 주장하고 있다. 양국의 주장이 워낙 현저하게 대립되고 있어서, 이러한 도서의 영유권 문제에 대한 시비는 가까운 시일 내에 쉽게 해결되지 않을 것이다.
그런데 우리는 중일 양국의 이 도서 분쟁의 추이를 주목하지 않을 수 없다. 여러 가지 면에서 띠아오위따오에 대한 중일 간의 분쟁은 독도에 대한 한일 간의 갈등과 유사한 점이 많기 때문이다. 따라서 띠아오위따오와 관련된 역사적․법적 이슈들은 일본의 독도에 대한 계속적인 주장에 대비하여 비교․분석해놓을 필요가 있다.
이러한 사정을 고려하여, 본 연구에서는 일본의 영토 분쟁들 중, 특히 띠아오위따오에 대한 몇 가지 문제들을 살펴보기 위한 것이다. 대략, 띠아오위따오의 명칭과 역사적 배경, 양국의 주장, 법적 쟁점 및 독도에 대한 함의를 중심으로 분석했다. 제삼자의 입장에서 어느 쪽의 입장이 더 타당한지 쉽게 판단할 수는 없지만, 적어도 역사적인 측면에 관한 한, 중국의 주장이 더 설득력이 있다는 것은 부인하기 힘들 것 같다.

영어초록

Diaoyudao consists of a group of small islands located at a distance of about 170km from the northeast coast of Taiwan, 330km away from the Chinese mainland, 170km away from the north of Ishigaki Island, and 410km away from the west coast of Okinawa. Diaoyudao is known as Senkakushoto or Senkakuretto in Japanese. As we can see from the island’s geographic features, being equally distant from Taiwan and Okinawa, conflict between China and Japan over the territoriality of Diaoyudao was always within the realm of possibility. In addition, it was not easy for a country to rule Diaoyudao effectively, as it was not suitable for permanent human habitation and there was no need for China and Japan as well as Ryukyu to do so.
Since 1971, Sino-Japanese territorial dispute over Diaoyudao has been one of the most difficult disputes in the world, as the islands are located in the area rich in hydrocarbon resources as well as strategically important for both countries. China and Japan stick to their respective opinions that the territoriality of its own country over the islands is unquestionable under international law or from historical point of view. As there is a great difference of opinions between the two states, the propriety of territorial disputes around these islands does not look to be resolved in the near future.
By the way, we can not help paying attention to the progress of this dispute. It is because there is considerable similarity between Sino-Japanese territorial dispute over Diaoyudao and Korea-Japan conflict over Dokdo. After examining relevant historical and legal issues relating to this dispute, we should prepare for the incessant Japan's territorial claim over Dokdo.
Taking into account these circumstances, this article surveys the issue of Diaoyudao out of Japan's territorial disputes, placing stress on name, history, state position, legal issue, and implication to Dokdo. Today, both China and Japan continue to have a variety of opposing opinions in connection with the territoriality over Diaoyudao. From the perspective of a third party, it may not be easy to regard the opinion of a state party as appropriate. Provided that one considers the historical aspects only, it seems hard to deny that the Chinese opinion is more persuasive.
