초록

지방자치의 시행 이후로 많은 지역에서 고유한 정체성과 특색을 담은 각종의 축제나 행사를 적극적으로 진행하고 있다. 다채로운 문화행사는 지역 이미지를 제고하고, 관광 수익의 증진 등 낙수 효과를 통해 지방자치와 지역 문화의 발전 및 지역 개발의 동력을 제공한다. ‘지방문화ㆍ예술의 진흥’에 관한 활동들은 지방자치단체의 자치 사무로서, 넓은 의미에서 공역무에 해당한다. 사적 주체의 자유와 창의에 의하여 이루어지는 문화와 예술의 영역은 정해진 법과 절차에 따라 규격화된 방식으로 행해지는 일반 행정 영역과는 차이점을 지난다. 문화 영역은 강제에 의하여 창조될 수 있는 부분이 아니며, 표현 및 예술의 자유 등 자유권적 기본권에 의하여 많은 보호를 받는다.
지방자치단체가 주최하는 각종 문화 행사나 정기적인 축제는 행사의 내용이나 목적이 다양하고, 이를 수행하는 조직이나 방식이 규격화되어 있지 않다. 행정 운영의 효율성을 확보하고 민간의 전문성과 사적 창의를 적극 활용하기 위하여, 기업이나 단체에 행사의 진행과 운영을 위탁하기도 한다. 그 과정에서 지방자치단체의 지역 문화 행사가 경제성과 효율성의 논리에만 급급하여 공공성을 잃어서는 안 될 것이며, 공익을 위한 최소한의 공법적 규율 가능성을 보장하는 것이 필요하다. 최근 지방자치단체에서 개최되는 수많은 축제들은 상업성에 비하여 지역의 정체성이나 공익성을 도출하기 어려운 경우도 많다. 지역 문화의 발전과 지방자치사무의 실효성 확보를 위하여, 지역 축제의 공공성에 대해서 고민하고, 안전관리 영역에만 국한되지 않는 행정의 관리·감독과 책임 법리가 종합적이고 체계적인 법제로 정비가 필요한 시점이다.
프랑스는 문화적 공역무(service public culturel) 개념을 통하여 지방자치단체의 다양한 문화 행사에 대하여 공법의 원리들을 적용하고, 그 법률관계의 체계적 틀을 확보하고자 노력해왔다. 지역 축제로서의 고유성과 특성을 지녔다면, 일반 사법이 아닌, 공법적 관점에서 규율할 수 있으며, 법령과 판례에 의하여 이론적 토대를 정비함으로써, 지방자치단체의 문화 행사에 관하여 발생할 수 있는 다양한 문제 상황들에 대하여 보다 적극적으로 대응할 수 있게 되었다. 지방자치단체의 모든 행사나 활동에 대하여 공역무성을 인정하는 것이 바람직하지 않으며, 업무 수행에 효율적인 방식도 아니라 할 것이다. 그러나 안전관리나 사후적으로 책임 문제가 발생할 시의 법적 소재의 규명에 국한되지 않는, 행사의 기획 단계부터 진행과 관리 및 종료까지의 과정을 공법적 관점에서 조망할 필요가 있다. 프랑스의 문화적 공역무 개념과 관련 법리는 우리의 지역 축제와 행사에 관한 총괄적인 법리를 개발하고 정립하는 데에 의미 있는 참고가 될 수 있다.

영어초록

Since local autonomy, many regions have been holding various festivals and events. Cultural events can enhance the regional image and provide a driving force for local autonomy, the development of local culture, and regional development through various tourism profits. Activities related to ‘promotion of local culture and arts’ are autonomous affairs of local governments and correspond to public service. The realm of culture is significantly different from the general administrative realm, which is conducted in a standardized manners according to laws and regulations. The cultural field is not something that can be created by force, and is greatly protected by fundamental rights such as freedom of expression. The promotion of local culture should move in the direction of establishing a foundation that guarantees and encourages citizens cultural life.
Various cultural events and festivals hosted by local governments vary in content and purpose, and the organization or method of carrying them out is not fixed. In order to ensure the efficiency of administrative operations and actively utilize private sector and private creativity, the hosting and operation of events are sometimes entrusted to private companies or organizations. Local cultural events by local governments should not lose their public character by focusing only on economy and efficiency, and it is necessary to guarantee the possibility of a minimum level of public regulation for public interest. Numerous festivals being held in local governments are often difficult to derive local identity or public interest compared to commercial ones. In order to develop local culture and ensure the effectiveness of local government affairs, the public nature of local festivals should be considered. And administrative management, supervision and responsibility that are not limited to the safety management area should be established as a comprehensive and systematic legal system.
France law systems apply the principles of public law to various cultural events of local governments through the concept of service public culturel. Even if it is a one-time event, if it has uniqueness and characteristics as a local festival, it can be regulated by public law rather than private law. In addition, by establishing a theoretical foundation based on laws and precedents, it is possible to respond more actively to various problematic situations that may arise regarding local government events. It is not desirable to recognize public character for all events of local governments, and it is not an efficient way to carry out. However, there is a need to look at the process from the planning stage of the event to progress and completion from a public law perspective, not limited to the identification of liability issues. France's concept of service public culturel and related theories may be a meaningful reference in developing and accumulating legal principles regarding our local festivals.
