초록

대상판결은 군법무관인 원고가 다른 군법무관들과 함께 국방부장관의 군 내 불온서적 반입 금지 지시에 대하여 헌법소원을 제기하였음을 이유로 받은 징계처분 등을 취소하였다.
헌법소원의 대상이 상관인 국방부장관의 지시라는 점에서, 군인의 복종의무와 국민으로서 재판청구권 행사가 일견 충돌하는 것으로 보이는 이 사안에서, 대법원은 재판청구권 행사의 목적이 이 사건 지시에 불복종하려는 것이 아니고, 이 사건 지시가 일반 군인들의 책 읽을 자유라는 정신적 기본권을 과도하게 제한하여 위헌의 의심이 있었다는 점 등에 비추어 볼 때, 복종의무에 위반되지 아니한다고 판단함으로써 군인의 재판청구권 행사가 복종의무에 위반되지 아니하는 기준을 제시하였다.
또한 법령의 근거가 없는 군 내 사전건의 절차를 거치지 아니하였다는 이유만으로 징계사유가 될 수 없다고 판단함으로써, 군인이라 하더라도 기본권을 제한하기 위하여는 헌법 제37조 제2항에 따른 법률유보원칙이 준수되어야 함을 확인하였다.
군무 외 집단행위란 군복무에 관한 기강을 저해하거나 기타 그 본분에 배치되는 행위라는 기존 법리를 확인하고, 그 판단 기준을 제시하였다.

영어초록

The subject case revoked the disposition of disciplinary action, which was imposed on the Plaintiff, a judge advocate general’s corps officer, or a military advocate, on the ground that he brought a constitutional complaint along with other military advocates against the order issued by the Minister of National Defense, which banned bringing seditious books into military barracks.
In the instant case where a soldier’s duty to obey and a citizen’s right to a trial appear to conflict on the surface in that the subject of the constitutional complaint is the order of the Minister of National Defense, who is a superior, the Supreme Court determined that the pertinent constitutional complaint did not violate a soldier’s duty to obey, in light of the fact that: (i) the purpose of exercising the right to a trial was not directed toward disobeying the instant order; and (ii) the instant order excessively restricted ordinary soldiers’ spiritual fundamental rights, that is, freedom to read, and carried a presumption of unconstitutionality, and thereby setting forth the standard for determining when exercising the right to a trial does not constitute a violation of the duty to obey.
Moreover, the subject case concluded that not having followed internal procedures requiring military personnels to make a proposal prior to seeking external resolution, which is not stipulated as a legal requirement, cannot constitute grounds for disciplinary action, thereby affirming that the principle of statutory reservations pursuant to Article 37(2) of the Constitution must be complied with even in a case where a person whose fundamental rights are restricted is a member of the armed forces.
In addition, the pertinent case confirmed the existing legal principle that a “collective action committed for purposes other than military service” means any activities that undermine military discipline or violate one’s duty as military personnel, and proposed the standard of determining what constitutes such a collective action.
