사회복지법의 헌법적 쟁점 – 아동복지법, 노인복지법, 장애인복지법 등에 관한 헌법재판소 결정을 중심으로 – (Some constitutional issues of the social welfare act in the constitutional decisions)

초록

사회복지법은 아동, 노인, 장애인 등 사회적 약자에게 개별적인 상황을 구체적으로 지원･보호하여 생활을 보장하고 사회에 참여하여 인격을 실현하는 목적을 갖는다. 그런데 이와 같은 제도목적과 규범구조 사이에는 뚜렷한 불균형이 있다. 즉 사회복지법이 입법목적을 구체적으로, 그리고 결과적으로 실현하여야 하지만, 개방적인 목표를 지향하기 때문에 추상적인 규정과 재량을 넓게 인정하는 규율방식은 어느 정도 피할 수 없다. 그 결과 구체적인 법률관계에 기초하여 권리와 의무가 형성되는 공간은 좁다. 헌법은 사회적 약자를 특별히 지원･보호하는 규정을 두고 있으며, 헌법과 헌법재판은 이를 새로이 인식하는 계기가 될 수 있다. 다만 헌법의 기능에도 한계는 있다. 헌법의 사회적 과제에 관한 규정이 명확하지 않기 때문에 입법 및 행정, 그리고 집행단계에서 구체화되어야 하며, 또 사회복지법의 규정방식의 특수성으로 인하여 권리구제의 가능성이 제한적이다. 이 두 가지 점이 헌법적 문제제기에도 소극적 영향을 미치고 있다. 이 글은 아동복지법, 노인복지법, 장애인복지법, 그리고 이에 관련된 법률 규정에 대한 헌법재판소의 결정을 비판적으로 분석･검토하여 이와 같은 문제와 문제의 규범구조를 밝히는 목적을 갖는다.

영어초록

The social welfare acts for the children, the elderly and the disabled have to provide them with the concrete support and benefits to make them live a decent lives and social participation, so to avoid their isolation from the social lives. The obvious imbalance between the institutional purpose and the normative structure is observed. The social welfare acts should, on the one hand, support and protect their recipients in a concrete and result-oriented method. They rely, on the other hand, on the abstract and open-to-discretion regulations with their variety of policy targets. This inherent characteristic of the social welfare acts result in the narrow and insufficient path of the concrete relationship with the individual right and obligation. This problem caused by the characteristic of the social welfare acts in terms of normative structure as well we benefits is more or less unavoidable. The constitutional provisions for the socially weak and the decisions on the relative measurements would motivate to be anew aware of this constitutional concern. However it confronts the functional hurdle from the constitution itself, for the constitutional provisions themselves are not clear in their method and contents to be realized, so they should be made concrete in the process of legislation, administration and execution. In addition the limited possibility of the judicial remedy hitherto in this field worked out negatively for the constitutional litigation. This article aims to critically analyse and evaluate the constitutional decisions on the social welfare acts and so to describe this problems and the normative structure of them.
