‘노인학대범죄의 처벌 등에 관한 특례법(안)’상 노인학대범죄사건의 처리절차에 대한 검토와 그 개선방안 (A Study about Processing Procedure of the Aged Abuse Crime in the 「Act on Special Cases concerning the Punishment, etc. of the Aged Abuse Crime(Bill)」 and Its Improvement)

우리 사회가 급격하게 고령화 사회로 진입하면서 노인문제가 증가하고 있고, 그 중에서 노인학대가 심각한 사회현상으로 대두되고 있다. 이에 정부는 2004년 1월 29일 「노인복지법」의 개정에서 노인학대의 예방과 대책을 위한 법적 근거를 처음 마련한 이후 수차례 개정·보완하는 한편, 국제적 기준에 맞추어 피해노인의 보호를 위한 노인보호전문기관의 설치 및 관련 정책을 마련·시행하고 있다, 하지만 노인학대에 대한 현행법의 규정이 미흡하여 노인학대의 예방과 피해노인의 보호에 있어서 실효성을 기대하기 어렵다는 비판이 제기되었다. 이에 최근 국회에서는 노인학대에 관한 독립법률인 ‘노인학대범죄의 처벌 등에 관한 특례법(안)’의 발의움직임이 있다. 이에 본고에서는 형사법적 관점에서 특례법안의 절차법 부분에 대하여 비판적으로 검토하고, 그 수정·보완할 점을 제안하였다. 즉, 특례법안이 피해노인의 보호와 학대행위자의 개선을 위한 실효적인 법률로 기능하도록 (i) 신고 활성화방안의 도입 및 신고의무자와 신고접수기관의 확대, (ii) 현장출동에 있어서 관계인의 협조의무 및 조사자에 대한 통제장치의 마련, (iii) 노인학대범죄사건 처리절차에 있어서 피해노인 및 노인보호전문기관의 의견 반영 확대, (iv) 가족의 신원 및 피해사실의 공개금지와 피해노인보호명령제도의 도입 등을 제안하였다.

영어초록

As our society became rapidly an aging society, problems of the aged are increasing in numbers. Among them, the aged abuse comes to the fore as a serious problem of the society. Therefore, on 29 January 2004, in amendment of 「Welfare of the Aged Act : WAA」, after making a legal basis on prevention and measures of the aged abuse, the government revised and complemented it three times. Also it established the aged protection institution and the policy for them were made and enforced to protect the aged abuse victims according to international standards.
However, questions are being asked regarding effectiveness of measures for prevention of the aged abuse and protection of the aged abuse victims. Some People think that such questions result from insufficiency of the existing provision of WAA as to the aged abuse. For this reason, recently in National Assembly, there was a movement for enactment of 「Act on Special Cases concerning the Punishment, etc. of the Aged Abuse Crime」which is an independent law regarding the aged abuse. Therefore in this paper I critically examine procedural law parts of this Bill from the perspective of the criminal law and suggest points to modify and to make up this Bill. To make this Bill to function as a law for the protection of the aged victims and the improvement of assailants, I suggest (i) the introduction of ways to activate of reporting, and the extension of the range of people bound in duty to give the abuse notification and the expansion of the agency receiving the abuse notification, (ii) the imposition of cooperation duty on the interested parties in the abuse case and the control on inspectors who are mobilized to the scene of abuse, (iii) the reflection of opinions of the aged abuse victims and Elder Protection Agency in the process of handling the aged abuse crimes, (iv) the disclosure prohibition of the identity of family members of the abused victims and the fact of abuse victim, and an introduction of ‘protection order system’ for the aged abuse victims.
